What multifamily in Fair Oaks looks like
Fair Oaks is mostly single-family and semi-rural, so multifamily here is a niche: duplexes and small apartment buildings in and around the Village, apartment complexes where County medium- and high-density zoning is mapped, and homes with ADUs on larger lots. See financing 2-4 unit properties and, for larger buildings, apartment building loans.
Where the zoning allows it
Fair Oaks is unincorporated, so the County’s Zoning Code applies, with RD districts named by units per acre. The Fair Oaks Community Plan, adopted January 8, 1975, described the area as primarily suburban and semi-rural and is now archived, so the zoning map is what counts. In the Village, the Fair Oaks Village SPA, adopted in 1979 and amended in 2012, sets its own residential districts.
| Zoning | Two units | Multifamily | Fair Oaks notes |
|---|---|---|---|
| Village SPA: Medium Density Residential | Duplex lots of at least 8,500 sq ft | Yes | Up to 20 units per acre. Single-family lots 5,200 sq ft. Care homes allowed |
| Village SPA: Low Density Residential | Duplex lots of at least 8,500 sq ft | No | Up to 7 units per acre |
| Village SPA: RD-30 underlying zone | Yes | Apartments | County RD-30 uses on mapped Village parcels |
| Village SPA: Commercial District | — | Apartments and housing with commercial buildings | Design review sets height and setbacks |
| Village NPA (RD-5) | ADUs under state law | No | New lots at least 8,712 sq ft. 36 ft height. 25–40% coverage |
| County RD-10 to RD-40 | Yes | Small to large apartments | Outside the Village, as mapped |
| County AR districts | Home plus ADU | No | Semi-rural lots |
Village SPA residential rules. Multifamily parking must be on site and sized to the project’s density, screened RV and boat parking is required in residential areas, and grading and tree removal need approval before work begins. New buildings go through design review for massing, materials and fit with neighbors, and the SPA sets no numeric height limit.
The NPA’s limits. The Fair Oaks Village NPA, adopted October 11, 2006, covers RD-5 parcels near the Village and protects their semi-rural character. Lot coverage is capped at 40% for a single-story home on a lot under a quarter acre, 33% for two stories, and 25% on lots of a quarter acre or more, counting ADUs, detached garages and sheds over 120 square feet. Variances must be noticed to every NPA owner and go to the Fair Oaks Community Council. A County memo approved January 28, 2021 confirms that state ADU law overrides more restrictive NPA rules, so an ADU remains possible, but coverage still shapes how large it can be.
SB 9. SB 9 applies to qualifying single-family lots in urban parts of Fair Oaks; confirm whether a parcel’s zoning, the NPA and any historic status affect eligibility. See our ADU investment guide and SB 9 lot split guide.
Rent rules: state law only
The Attorney General’s rent cap page, updated July 16, 2026, puts Sacramento County in All Other Counties: covered units may rise up to 7.7% for increases from August 1, 2025 and 8.6% from August 1, 2026 through July 31, 2027. Only the City of Sacramento appears on the AG’s local ordinance chart for this county, and Fair Oaks is outside it. Owner-occupied duplexes and single-family rentals may qualify for exemptions with the proper notice. See our AB 1482 guide and just cause eviction guide.
Fair Oaks rental property rules
- County rental registration. Every residential rental in unincorporated Fair Oaks must be registered under the County’s Rental Housing Inspection Program, at $16 per unit per year, usually billed on the first County utility bill of the year. Trained owners can self-certify, subject to random audits.
- Short-term rentals. Under the County’s STR permit rules, the owner or a long-term renter must live on site at least six months a year, each rental party is limited to 29 days a year, and only a permitted primary home or an ADU permitted before January 1, 2020 can be rented. JADUs and guest houses cannot. Rentals also need a County business license and TOT registration.
- Transfer tax. Only the County’s $0.55 per $500 applies, per the County Clerk-Recorder.
Hillsides, trees and older buildings
Where Village lots are steep, the SPA asks hillside buildings to use the slope, with tiered or cantilevered designs, while keeping grading minimal. Tree removal before approval is prohibited, which can shape where a new unit or parking area can go. Older wood-frame buildings warrant a seismic retrofit review, and buildings with three or more units and elevated decks or stairs need SB 721 balcony inspections. Near the American River, the County’s PC Parkway Corridor and F flood combining districts may also apply.
