What multifamily in Sunnyvale looks like

Sunnyvale’s income property includes duplexes and small buildings in R-2 neighborhoods, garden apartment complexes in R-3 and R-4, higher-density buildings downtown, and a significant number of mobile home parks in their own R-MH district. The newest large-scale capacity is in the Moffett Park Specific Plan, which opens parts of a former office park to very high-density housing. For two to four units, read financing 2-4 unit properties; for larger buildings, see apartment building loans.

Where the zoning allows it

Chapter 19.18 sets each residential district’s maximum density.

District Duplex 3 to 50 units Over 50 units Max density
R-0, R-1 Not permitted Not permitted Not permitted 7 units/acre
R-1.5 Use permit Not permitted Not permitted 10 units/acre
R-1.7/PD Special development permit Not permitted Not permitted 14 units/acre
R-2 Permitted Permitted Use permit 12 units/acre
R-3 Permitted Permitted Use permit 24 units/acre
R-4 Permitted Permitted Use permit 36 units/acre
R-5 Use permit Permitted Use permit 45 units/acre; may combine with office or hotels
R-MH Owner/operator only Permitted Use permit 12 units per acre of park
Moffett Park MP-AC, MP-MU, MP-R Not permitted Special development permit Special development permit Minimum densities in the plan

Density bonus and by-right sites. Section 19.18.025 allows density above these maximums under the state density bonus law and city incentives. Housing on sites listed in Chapter 19.73 needs only a ministerial miscellaneous plan permit.

Downtown. In the Downtown Specific Plan, duplexes are allowed only on Blocks 8, 9, 10, 11, 12 and 17, and multifamily generally needs a special development permit. Multifamily parking is one assigned covered space per unit plus unassigned spaces by bedroom count.

ADUs and SB 9. ADUs follow Chapter 19.79 citywide. Sunnyvale implements SB 9 through its urban lot split chapter (18.26) and Dual Urban Opportunity Housing rules (Chapter 19.78). See our ADU investment guide and SB 9 lot split guide.

Rent rules: AB 1482 plus Sunnyvale tenant protections

The Attorney General’s rent cap page, updated July 16, 2026, places Santa Clara County in All Other Counties, with covered units allowed up to 8.6% for increases from August 1, 2026 through July 31, 2027, and does not list Sunnyvale among cities with local rent stabilization. Sunnyvale does not cap rents, but it adds its own tenant protections under Chapter 19.71, adopted by Ordinance 3215-23:

  • One-year lease offers. Owners must offer covered tenants a written lease of at least one year. Tenants have five days to accept or decline; offering a menu of one-, three-, six- or 12-month terms satisfies the rule.
  • Relocation for no-fault terminations. Owners must give 30 days’ written notice of relocation rights before a termination notice and pay two months’ rent, half within 15 days of the termination notice. Missing these steps voids the notice.
  • Notices and posting. Tenants get a written rights notice, and a summary poster with Housing Division contacts must hang in a common area.
  • Coverage. The chapter covers rental units including non-owner-occupied mobile home spaces, excludes most AB 1482 exemptions and short-term rentals, and is internally unclear on whether newer buildings are covered; confirm with the Housing Division.

Sunnyvale rental property rules

  • Short-term rentals. Under Chapter 19.76, only hosted rentals in the host’s primary residence are allowed, with the host on site, stays of 30 days or less and four lodgers per night. ADUs approved on or after January 1, 2020 and Dual Urban Opportunity units cannot be short-term rentals. Each rental needs city approval and pays transient occupancy tax.
  • Mobile home park conversions. Chapter 19.72 requires 90 days’ notice before filing, a resident organization’s 90-day right to negotiate a purchase, a council-approved conversion impact report and relocation benefits, including up to 24 months of rent subsidy for qualifying households, and at least 180 days’ notice of termination. A park reaching 25% vacancy can trigger the rules.
  • Transfer tax. The County’s documentary transfer tax is $0.55 per $500, and Sunnyvale’s Chapter 3.08 sets 27.5 cents per $500, generally credited within that amount.

Older complexes and building issues

Sunnyvale’s garden apartment complexes are largely wood frame, many with carports or tuck-under parking; review them for seismic retrofit needs. Buildings of three or more units with elevated balconies, stairs or walkways need SB 721 balcony inspections. Moffett Park residential projects must also meet GreenPoint Rated and open space requirements, which affects new-build budgets.

Underwriting a Sunnyvale multifamily purchase

  1. Confirm the district; buildings over 50 units in R-2 to R-5 need a use permit, so check the permit history.
  2. Model AB 1482 increases at or below 8.6% for covered units.
  3. Budget two months’ rent per unit for any no-fault termination under Chapter 19.71.
  4. Check that one-year lease offers and rights notices were given; ask for copies.
  5. Collect leases, the rent roll and estoppel certificates.
  6. Rebuild expenses with reassessed taxes, SB 721 and seismic costs in our rental property analysis.
