What multifamily in Santa Clara County looks like
Almost all of the county’s apartments are in its 15 cities, led by San Jose’s large stock of fourplexes, garden complexes and newer mid-rise buildings, plus significant inventories in Santa Clara, Sunnyvale, Mountain View and Campbell. Unincorporated income property is a smaller niche: duplexes and small buildings in urban pockets surrounded by San Jose or Los Gatos, Stanford-area campus housing, and rural homes with ADUs in San Martin and the hills. For two to four units, read financing 2-4 unit properties; for five or more, see apartment building loans.
Where the zoning allows it
Inside cities, city codes apply; see our San Jose, Santa Clara, Sunnyvale, Mountain View and Campbell pages. Santa Clara LAFCO notes the Urban Development Policies direct urban development to land annexed to cities, so County residential districts mainly cover pockets inside city urban service areas. Chapter 2.30 sets them out:
| County district | What it is for | Multifamily rules |
|---|---|---|
| R1, R1E One-Family | Single-family homes | 5,000 sq ft minimum for new lots; ADUs and SB 9 |
| R2 Two-Family Residence | One- and two-family homes | Duplexes by right |
| R3 Multi-Family Residential | Intensive multifamily in accessible urban locations | Duplexes by right; multifamily with architecture and site approval; density per the city’s general plan; 45 ft and four stories; 50% coverage |
| R1S Low-Density Campus Residential | Stanford lands | Up to 8 units per net acre |
| R3S Medium-Density Campus Residential | Stanford lands | 8 to 15 units per net acre |
| RHS Urban Hillside | Low-density foothill housing in hazard areas | Slope-density formula; one-acre minimum |
| CN, CG, OA Commercial | Commercial pockets | Two-family and multifamily by use permit and architecture and site approval |
The R3 rule that density follows the applicable city’s general plan is distinctive: two County R3 parcels in different city service areas can allow very different unit counts. In commercial districts, parcels with an -os designator are limited to multifamily and limited mixed-use housing, per Chapter 2.40.
ADUs and SB 9. County ADU and SB 9 rules come from Ordinance NS-1200.383, adopted January 24, 2023. In a June 24, 2025 letter, the state housing department found it out of step with state law on points including the County’s ban on separate ADU sale, ADU height limits, a 180-day minimum rental term for SB 9 units (state law allows 30) and treatment of the A, AR and HS zones. Check whether the County has amended the ordinance before relying on a specific rule. See our ADU investment guide and SB 9 lot split guide.
Rent rules: city ordinances, County tenant protections and AB 1482
The Attorney General’s rent cap page, updated July 16, 2026, places Santa Clara County in All Other Counties: 7.7% for increases from August 1, 2025 and 8.6% for increases from August 1, 2026 through July 31, 2027. Its chart of local rent ordinances lists San Jose and Mountain View in this county. Older apartments in those two cities follow local rent rules; see their city pages.
Unincorporated County. A County tenant protection presentation, prepared by the Office of Supportive Housing, County Counsel and Planning, notes that County Code Division C5 already requires relocation help when tenants must leave unsafe or red-tagged units. It proposed covering single-family homes, duplexes and condos, tenants of under a year and buildings under 15 years old, with no-fault relocation of three months of Fair Market Rent. Local press reported the Board approved the expanded ordinance 4-1 on June 2, 2026; we did not find the adopted text on a County site, so confirm the final terms and effective date. Read our AB 1482 guide and just cause eviction guide.
Santa Clara County rental property rules
Because rules differ sharply across the 15 cities, the first rental-rule question is always which city, if any, controls the building. For unincorporated pockets, the County’s relocation and tenant rules apply on top of state law, and annexation would bring the building under the city’s rules instead. The LAFCO brochure notes that the policies encourage cities to annex their islands, so a pocket building’s rules can change during your hold.
Hillsides, older stock and pocket utilities
County hillside parcels in RHS follow a slope-density formula, so steeper land allows fewer units, and many rural parcels rely on septic, which the state flagged as a subjective standard for SB 9 in its review. Older apartment buildings in San Jose and Santa Clara with elevated decks need SB 721 balcony inspections at three or more units, and wood-frame soft-story buildings warrant a seismic retrofit review. Unincorporated pockets may lack sewer, and connection often depends on the surrounding city.
