What multifamily in Elk looks like
Elk has almost no conventional multifamily housing. The 2025 LAFCo water district review estimates about 45 permanent residents, rising to about 100 seasonally. It describes a village of mostly second homes and short-term vacation rentals, with 88 residential water connections. In Elk, "income property" usually means a house with a legal ADU or JADU, a small inn with an owner’s unit, or a mixed building on Highway 1. Long-term rentals are scarce, and septic capacity, water supply and coastal permits decide how many units a parcel can hold. For financing, see financing 2-4 unit properties and apartment building loans.
Where the zoning allows it
Elk is unincorporated and entirely in the Coastal Zone. The county’s Coastal Zoning Code applies, and land use changes need Coastal Commission certification. The LAFCo review says most of Elk carries the Rural Village designation, with RR5, RL 160, OS and PF districts around it.
| District | Two-family / multifamily | Density | Housing notes |
|---|---|---|---|
| RV Rural Village (Ch. 20.388) | Not listed as permitted or conditional | One single-family home per 6,000, 12,000 or 40,000 sq ft, depending on water and sewer service | Vacation home rentals by right. B&Bs, inns and hostels by coastal use permit |
| RR Rural Residential (RR5) | Not a multifamily district | 5-acre designation | ADU subject to septic and coastal rules |
| RL Range Lands (RL 160) | No | 160-acre designation | Ranch housing only |
| OS / PF | No | — | No housing development |
In RV, the code lists single-family dwellings and vacation home rentals as by-right residential uses and writes its density rules for single-family homes. Elk has public water but, for most lots, no sewer. Under the one-service rule, a new home generally needs a 12,000 square foot lot. Additional units come from ADUs, JADUs or legal nonconforming buildings, not from new duplexes or apartments.
ADUs. The county’s ADU page allows detached ADUs up to 1,200 square feet and JADUs up to 500. JADUs require owner occupancy. ADUs cannot go on a leach field or its replacement area, and new ADUs need solar. In the Coastal Zone, an ADU may also need a Coastal Development Permit, and coastal rules in Chapter 20.458 address water availability and vacation rental use. See our ADU investment guide.
SB 9. SB 9 applies only to qualifying urban single-family lots, and Elk generally does not qualify. Confirm with Planning and see our SB 9 lot split guide.
Rent rules: state law only
The Attorney General’s rent cap page, updated July 16, 2026, puts Mendocino County under All Other Counties. The cap for covered units is 7.7% for increases from August 1, 2025, and 8.6% for increases from August 1, 2026 through July 31, 2027. No Mendocino County jurisdiction appears on the AG’s chart of local rent ordinances. Covered tenancies follow state just cause rules. Many single-family homes, including a house rented with its ADU, may be exempt with the required notice. See our AB 1482 guide and just cause eviction guide.
Elk rental property rules
- Vacation home rentals. RV lists vacation home rentals as a by-right use, which explains Elk’s large short-term stock. Coastal ADU rules restrict vacation rental use of ADUs, so check before counting on short-stay income from a second unit.
- Transient occupancy tax. Stays of 30 days or less pay county TOT under Chapter 5.20, with a registration certificate for each parcel, plus a Business Improvement District assessment paid through the Treasurer-Tax Collector.
- Water billing. The water district charges B&B inns a share of a residential unit equivalent per guest room, so adding rooms adds water charges.
- Transfer tax. The county collects documentary transfer tax through the Recorder, which does not post the rate. There is no city tax.
Water, septic, bluffs and coastal permits
The Elk County Water District, formed in 1957, serves about 128 acres from one active well beside Greenwood Creek, with a standby well. Its treatment plant was built in 1979, upgraded in 2002 and permitted for 42 gallons per minute. The LAFCo review expects the roughly six remaining buildable lots to fit within capacity. It also flags annual operating losses, no capital improvement plan and an aging 84,000-gallon tank due for replacement in 2026. Plan for possible rate increases.
Wastewater is mostly individual septic, and a community leach field serves only about 10 downtown parcels. The county’s Coastal Zone page requires proof of an adequate water supply before new development. A CDP typically takes six to twelve months. Oceanfront lots face bluff and visual resource review. Older wood-frame inns and cottages may warrant a seismic retrofit review. Buildings of three or more units with elevated decks need SB 721 inspections.
Underwriting an Elk multifamily purchase
- Order a county Letter of Zoning to confirm the district, overlays and any violations.
- Confirm the legal status and permits of every unit, since RV is written for single-family homes.
- Get the septic records or community leach field connection, and the water district account terms.
- Separate long-term and vacation rental income, and confirm TOT registration and ADU vacation rental limits.
- Classify units under AB 1482, model increases at or below 8.6%, and collect estoppel certificates.
- Rebuild expenses with reassessed taxes, insurance and water rate risk in our rental property analysis.
Questions people ask
Does Elk have rent control?
No. AB 1482 caps covered units at 8.6% for increases from August 1, 2026, and no local ordinance applies.
Can I build a duplex in Elk?
Generally not as a new duplex. The RV district lists single-family homes, not two-family or multifamily dwellings. ADUs and JADUs are the usual way to add a unit.
Can an Elk ADU be a vacation rental?
Coastal ADU rules restrict vacation rental use, so confirm with the county before relying on short-stay income.
Is there enough water to add units?
The water district’s review expects remaining buildable lots to fit within capacity. Any new unit still needs proof of water supply and usually a coastal permit.
How big can a lot be in Elk’s village zone?
RV minimum lot sizes are 6,000 square feet with water and sewer, 12,000 with one service and 40,000 with neither.
Who regulates development in Elk?
Mendocino County, under the Coastal Zoning Code, with Coastal Commission certification for land use changes.
