What multifamily in Carmel Highlands looks like

Carmel Highlands is a low-density coastal neighborhood, not an apartment market. Income property here usually means a single-family home with a guesthouse, senior unit or second unit, an older property with a legal additional dwelling, or employee housing attached to a visitor-serving business. Each added unit is limited by zoning density, septic capacity and water, and by the area’s viewshed policies. For financing basics, see financing 2-4 unit properties and apartment building loans.

The area is unincorporated and entirely in the Coastal Zone. Monterey County’s coastal zoning code, Title 20, and the Carmel Area Land Use Plan, certified by the Coastal Commission on April 14, 1983, set the rules. The plan’s land use chart shows about 740 acres of Low Density Residential in Carmel Highlands.

Where the zoning allows it

Low Density Residential land is generally zoned LDR(CZ), Chapter 20.14. Its density comes from the map suffix: LDR/2, for example, means one unit per two acres. Confirm the suffix on the Sectional District Map: a lot smaller than its density figure may already hold its only allowed unit.

Use in LDR(CZ) Permit level Notes
First single-family home Coastal administrative permit One per legal lot
Guesthouse Coastal administrative permit Must meet Section 20.64.020
Senior citizen unit Coastal administrative permit Must meet Section 20.64.010
Second residential unit Coastal administrative permit Only within the zoning density
Additional units, up to 4 per lot Coastal development permit Only within the zoning density
Caretaker unit Coastal development permit Must meet Section 20.64.030
Bed and breakfast Coastal development permit Section 20.64.100
Farm employee housing, up to 2 families or 5 people Coastal administrative permit Larger needs a coastal development permit

LDR sets a 30-foot main height, 15 feet for accessory buildings, 15% maximum site coverage and a one-acre minimum building site unless clustered. Main buildings need 30-foot front and 20-foot side and rear setbacks. In the Yankee Point area, the Carmel Area plan’s 1995 amendment lowers heights to 20 feet for seaward properties and 26 feet for others.

Duplexes are not listed in the LDR chapter. Visitor-serving parcels in VSC(CZ), Chapter 20.22 can have one caretaker unit by administrative permit and accessory employee housing by coastal development permit.

ADUs and SB 9. State ADU law applies in the Coastal Zone but does not override the Coastal Act, so an ADU still needs a coastal permit and must meet septic, water and visibility rules. SB 9 applies in unincorporated areas only inside Census urbanized areas or urban clusters; whether any Highlands parcels qualify should be confirmed with the County. See our ADU investment guide and SB 9 lot split guide.

Rent rules: state law only

Rent caps. The Attorney General’s rent cap page, updated July 16, 2026, puts Monterey County in All Other Counties. Covered units may rise up to 7.7% for increases from August 1, 2025, and 8.6% from August 1, 2026 through July 31, 2027. The AG’s chart lists Salinas as the only local rent ordinance in the county, not unincorporated areas. See our AB 1482 guide.

Just cause. Covered tenancies follow state just cause rules. A single-family home or guesthouse owned by an individual can be exempt from AB 1482 if the lease includes the required notice. See our just cause eviction guide.

Carmel Highlands rental property rules

  • Vacation rentals. The County’s short-term rental page says existing coastal rules govern until the Coastal Commission certifies the County’s new ordinance. Until then, renting for 30 days or less needs a coastal development permit under the similar-use category, which the County estimates at about $12,000. The Board approved coastal Ordinance 5439 on September 23, 2025; check its certification status.
  • Lodging tax. Owner-rented homes owe the County’s 10.5% transient occupancy tax. Operators must register and post a certificate, and paying the tax does not make an unpermitted rental legal.
  • B&Bs. Bed and breakfasts need a coastal development permit in LDR.

Septic, water and hillside issues

Septic. The Carmel Area plan names septic and leachfield failures in the Carmel Highlands area as a source of pollution, with Point Lobos waters treated as an Area of Special Biological Significance. Policy 2.4.4.B.6 requires dual leach fields for any new development in Carmel Highlands, and Policy 2.4.4.B.5 bars new onsite systems on slopes over 30%. Adding a unit usually means proving room for two leach fields, which can be hard on steep lots. Ask whether the parcel is on septic or connected to a sewer.

Water. Policy 2.4.4.A.1 requires proof of adequate water for new development. If the parcel is in the Cal Am system within the Monterey Peninsula Water Management District, the District’s water permit rules apply before a building permit can issue or a meter can be set, and any intensification of use needs a permit. Confirm the provider and any existing water credits.

Hillsides. New development must be carefully sited to minimize visibility under Policy 2.2.3.3, and slopes of 30% or more trigger a coastal development permit. Older hillside homes and decks warrant a seismic retrofit look, and SB 721 applies only to buildings of three or more units with elevated decks.

Underwriting a Carmel Highlands multi-unit purchase

  1. Confirm the LDR density suffix and whether the lot already uses its allowed units.
  2. Verify the coastal permit for every guesthouse, senior unit, second unit or caretaker unit.
  3. Inspect the septic system and confirm dual leach field capacity, or sewer service.
  4. Confirm the water provider and, if in MPWMD, the parcel’s water permit history.
  5. Classify units under AB 1482 and model covered increases at or below 8.6%; collect leases and estoppel certificates.
  6. Rebuild expenses with reassessed taxes, fire insurance and septic maintenance in our rental property analysis.
