What multifamily in Monterey County looks like
Most of the county’s apartment stock is in Salinas, Seaside, Monterey and Marina, with smaller duplex and fourplex neighborhoods in Pacific Grove and the South County farm towns. Unincorporated income property is more scattered: duplexes and small complexes in Castroville, Boronda and Prunedale, newer townhomes in East Garrison, second-story units over shops in Moss Landing, and homes with ADUs in Carmel Valley. For two to four units, read financing 2-4 unit properties; for larger buildings, see apartment building loans.
Where the zoning allows it
City codes govern inside the twelve cities; see our Salinas, Monterey, Seaside and Marina pages. In the unincorporated County, inland parcels follow Title 21 and coastal parcels follow Title 20. In both, the zoning map’s number after the district sets the maximum density, so "HDR/10" means 10 units per gross acre.
| County district | What the code says it is for | Multifamily rules |
|---|---|---|
| HDR High Density Residential (Ch. 21.10) | High-density housing where services exist or can be provided | Duplexes and multiple dwellings by right to 5 units/acre; administrative permit to 8; use permit above 10 |
| MDR Medium Density Residential (Ch. 21.12) | Medium-density housing with on-site amenities | First duplex on a vacant lot by administrative permit; up to four units by use permit; 6,000 sq ft minimum site |
| LC and HC Commercial (Ch. 21.18, 21.20) | Commercial districts | Housing by use permit if its floor area does not exceed the commercial floor area |
| MU Mixed Use (Ch. 21.17) | Combined commercial and residential | |
| MLC(CZ) Moss Landing Commercial | Mixed commerce and homes on Moss Landing Road | Second-story units over commerce up to 4 units/acre with a coastal permit |
| HDR(CZ), MDR(CZ) | Coastal residential districts | Coastal development permit rules apply |
The HDR chapter sets a 35-foot height limit unless the map shows a lower one. The MDR chapter caps site coverage at 35%, limits main buildings to 30 feet, and carves Del Monte Forest out of its second-home and duplex provisions. Projects of more than five units on an MDR lot need a trash enclosure and recreation area. The County’s plans library shows a Housing Element adopted June 15, 2010 alongside the 2010 General Plan.
ADUs are allowed in both HDR and MDR when they meet County Section 21.64.030; see our ADU investment guide. SB 9 lot splits apply only to qualifying urban single-family lots, so most farmland and grazing parcels will not qualify.
Rent rules: state law, plus Salinas rent stabilization
The Attorney General’s rent cap page, updated July 16, 2026, places Monterey County in All Other Counties: 7.7% for increases from August 1, 2025 and 8.6% for increases from August 1, 2026. Its chart of local ordinances lists Salinas as the only Monterey County city with local rent stabilization.
Salinas’s rental registration and rent stabilization page limits increases on multifamily buildings built before February 1, 1995 to the lesser of 2.75% or 75% of the 12-month CPI-U change. All residential rentals must register, at $112 per stabilized unit and $29 per other unit for 2026. The ordinances took effect January 1, 2025, and the City Council placed a repeal measure on the November 3, 2026 ballot; they remain in force until voters decide. Check the result before closing on a Salinas building. Unincorporated areas near Salinas, such as Boronda, are not covered by the city ordinance. Read our AB 1482 guide and just cause eviction guide.
Monterey County rental property rules
Short-term rentals. The County’s short-term rental page requires a discretionary permit for stays of 30 days or less, available only in certain districts, and a coastal similar-use permit the County estimates at about $12,000. The HDR and MDR chapters list homestays and limited vacation rentals under Section 21.64.290. Operators must register for the 10.5% transient occupancy tax and, since October 11, 2024, hold a County business license.
Coastal vacation rentals. The Board adopted coastal Ordinance No. 5439 on September 23, 2025, according to the County’s ordinance page; confirm its Coastal Commission certification status.
Water on the Peninsula and coastal permits
Water is the defining constraint west of Salinas. The Monterey Peninsula Water Management District requires a water permit before a building permit can set a meter, add a meter or intensify use on an existing connection, so adding an ADU or converting a duplex to a triplex can hinge on water credits. Along the coast, development needs coastal permits under the Local Coastal Program the Coastal Commission certified in 1988. Older wood-frame buildings with elevated decks need SB 721 balcony inspections at three or more units.
