Commercial Real Estate in Canyon: What Business Use Is Possible and How to Check It
By Matthew Martinez, Founder, CEO & Managing Broker, Diamond Real Estate Group. California DRE #01869679.
Canyon is a tiny unincorporated community in a redwood canyon between Moraga and Oakland, reached by Pinehurst Road and Canyon Road. This guide does not establish a mapped commercial district or industrial entitlement. The few non-residential properties are things like the Canyon Elementary School District campus, home-based businesses and rural parcels on large lots. "Commercial real estate" here means understanding which limited business uses county zoning allows on a particular parcel and what the site can physically support. Confirm both with Contra Costa County before buying for a business use.
Who controls the parcel
Canyon has no city government. A 2026 county project notice on CEQAnet describes it as a tiny unincorporated community. Land use is regulated by Contra Costa County’s Department of Conservation and Development under Division 84 of the County Ordinance Code. Other agencies:
- Fire. The Moraga-Orinda Fire District says it serves Moraga, Orinda and nearby unincorporated areas, naming Canyon and Bollinger Canyon. The district formed in 1997, covers about 42 square miles and serves about 38,500 people. It notes that parts of its territory are in state-designated Very High Fire Hazard Severity Zones.
- Schools. Canyon has its own elementary school district. The California Department of Education lists the Canyon Elementary district at 187 Pinehurst Road.
- Drainage and creeks. The county’s Public Works and planning staff issue drainage permits for work affecting creeks. The 2026 notice involved replacing a failing 72-inch culvert under the only driveway to a home at 50 Pinehurst Road. The work required a county drainage permit, creek-slope armoring and possible riparian vegetation removal.
- Water and sewer. We could not confirm from official sources which agency, if any, provides water or sewer to Canyon parcels. Contra Costa LAFCO’s EBMUD profile lists Moraga in its water area but does not mention Canyon. Assume a parcel may rely on a well, a spring or a private system and septic until a provider confirms otherwise.
County zoning that may apply in Canyon
We did not confirm which districts are mapped in Canyon. Read the county zoning map for the specific parcel. Rural and wooded areas of the county commonly carry districts such as these:
| District | Business uses the code allows | Notes |
|---|---|---|
| F-R Forestry Recreation | Parks, summer homes, hotels, golf courses, organized camps and other recreational uses. Gift shops, tea rooms and child care centers by land use permit | ½ acre lots for homes. 50 ft or four stories. 25 ft setback from public roads. 35 ft total side yards |
| A-2 General Agricultural | Farming, farm stands. By land use permit: stables and riding academies, kennels, outdoor commercial recreation, farm markets, medical offices, museums, private schools | One home plus ADU by right |
| Single-family districts (R-20, R-40, R-65, R-100) | Homes, ADUs and home-based businesses as the county allows | Large-lot residential |
The cannabis exclusion district lists nine areas, and Canyon is not one of them. But A-2 allows commercial cannabis only with a land use permit under the county’s cannabis chapter. Confirm current county cannabis policy before relying on that.
What business uses are realistic
- Home-based work. Most Canyon businesses are run from homes. Confirm county home occupation limits on signage, employees and customer visits.
- Recreation and retreat uses. If a parcel is F-R, the code lists camps, summer homes, recreation uses and hotels. A tea room or gift shop needs a land use permit. Any of these would face fire, access and septic review, and neighborhood opposition is likely in a community this small.
- Agricultural and equestrian uses. On A-2 land, stables, riding academies and outdoor recreation are land use permit uses. Farm stands are allowed by right.
- Lodging and short stays. We did not verify county short-term rental rules. Confirm them with the county before relying on vacation rental income.
Physical constraints that decide business use
- Fire. Canyon is surrounded by wildland. MOFD notes Very High Fire Hazard Severity Zones in its territory. Expect fire code requirements for access, water supply, defensible space and building materials on any change of use.
- Access. Pinehurst Road is narrow and winding, and some homes depend on single driveways over creeks, as the 2026 culvert notice shows. Customer traffic and delivery trucks are practical problems.
- Creeks. Work near a creek needs county drainage review and may need state and federal permits.
- Water and wastewater. Confirm the water source and septic capacity for any added employees or visitors.
Transfer tax, business tax and property tax
The Contra Costa Clerk-Recorder charges the county documentary transfer tax of $0.55 per $500. Canyon is unincorporated, so no city transfer tax applies. A sale is generally a Proposition 13 change of ownership. We did not verify a county business license requirement.

Canyon’s adopted planning priorities
The 2045 Contra Costa General Plan, Canyon guidance calls for parcel-specific access review, habitat protection and development compatible with the community’s unusual topography and historical building pattern. Its actions include drainage work along Pinehurst Road, emergency turnarounds along Pinehurst and Canyon Roads, and possible zoning changes. These are adopted planning directions, not evidence that a rezone or road improvement has been completed. Compare today’s parcel map and permit file with those directions before treating a proposed business or additional dwelling as feasible.
