What multifamily in San Diego County looks like

Most of the county’s apartment buildings, duplexes and fourplexes are inside its 18 cities, from beach-town duplexes in the north coastal cities to large garden complexes in the South Bay and East County. The unincorporated area adds duplexes and small apartment buildings in suburban communities such as Spring Valley, Lakeside and Fallbrook, mobile home parks, and rural properties with second units on septic. Rules differ sharply by city. For two to four units, start with financing 2-4 unit properties; for larger buildings, see apartment building loans.

Where the zoning allows it

In the unincorporated area, the County Zoning Ordinance applies, and the County’s Property Summary Report shows the zoning for a parcel number. The County’s ordinance summary describes the residential use regulations:

County use regulation Housing it is meant for
RS Single-Family Residential Single-family homes
RD Duplex Residential Duplexes
RM Multi-Family Residential Apartments and other multifamily
RV Variable Family Residential Mixed family housing types, including multifamily
RU Urban Residential Family residential where services are adequate
RMH Mobilehome Residential Mobile home parks and subdivisions
C31, C34, C35, C36 Residential with or above commercial uses

Density, lot size and building type are set separately in the development regulations, so two RM parcels can carry very different unit counts. Check the parcel’s density designator in the Property Summary Report.

ADUs and separate sale. County ADU guidance allows detached ADUs up to 1,200 square feet and JADUs up to 500, offers pre-approved plans, and notes that the impact fee waiver ended January 9, 2024. On March 4, 2026 the Board of Supervisors adopted a program allowing ADUs in unincorporated communities to be sold separately through condominium conversion with a tentative map. See our ADU investment guide and SB 9 lot split guide, and note that SB 9 applies to urban single-family lots, not to most rural agricultural parcels.

Rent rules: state law, plus a few local programs

The Attorney General’s rent cap chart treats San Diego County as its own CPI area and lists the cap at 8.8% for increases starting August 1, 2025 and 8.2% for increases from August 1, 2026 through July 31, 2027. Its chart of local rent ordinances lists no San Diego County city, but it warns that it may not include every local protection. Our research found local rules in at least two cities: Chula Vista’s Tenant Protection Ordinance adds just cause limits and larger relocation payments, and Escondido’s voter-approved mobilehome rent control requires a hearing for space rent increases. Read our AB 1482 guide and just cause eviction guide, then check the city page for any building you are considering.

Rental property rules across the county

Short-term rentals vary by city. Coronado bars stays of 25 days or less in residential zones, Carlsbad allows them only in its Coastal Zone and one master plan area, and Encinitas and Chula Vista run permit systems. In the unincorporated area, the County’s transient occupancy tax ordinance imposes 8% on stays of 30 days or less and requires operators to register with the Tax Collector.

Advisory review. Multifamily projects on County land go to the local community planning or sponsor group listed on the County’s community groups page, which advises the County but does not decide.

Septic, water and jurisdiction issues

The County’s environmental health department sizes residential septic systems by the number of bedrooms in each dwelling unit and holds septic jurisdiction throughout the county, including the cities, according to its septic FAQ. Records for systems since the late 1970s are filed by parcel number. On rural income property, septic capacity is usually what limits added units. City edges shift through LAFCO annexations, and the County’s General Plan page notes that tribal, military, state and federal lands are outside County zoning. For older buildings anywhere in the county, plan for SB 721 balcony inspections on three or more units.

Underwriting a San Diego County multifamily purchase

  1. Confirm the jurisdiction by parcel and read that city’s or the County’s zoning and density rules.
  2. Check the city page for local tenant, relocation or mobilehome rules on top of AB 1482.
  3. Model increases at or below 8.2% for covered units.
  4. On septic, compare the recorded system design to the bedroom count.
  5. Collect leases and statements, and obtain estoppel certificates.
  6. Rebuild expenses with reassessed taxes and any Mello-Roos charges in our rental property analysis.
