What multifamily in Chula Vista looks like

Chula Vista’s rental stock includes duplexes and garden apartments in the older western neighborhoods, newer apartment and condominium communities in the eastern planned villages, and a meaningful number of mobilehome parks with their own zone and rent review law. What sets the city apart from most of San Diego County is its local tenant protection ordinance, which adds relocation payments and notice duties on top of state law. For two to four units, see financing 2-4 unit properties; for larger buildings, see apartment building loans.

Where the zoning allows it

Zone Intended housing Notes
R-2 One- and Two-Family Lowest-density multifamily, mainly duplexes Keeps single-family character; attached homes on lots as small as 3,500 sq ft by map
R-3 Apartment Residential Apartment neighborhoods of varying density Garden apartments to multistory buildings; limited resident-serving retail by permit
MHP Exclusive Mobilehome Park Mobilehome parks New parks by conditional use permit
C-C Central Commercial Housing combined with shops or offices Business hubs and General Plan mixed-use areas
P-C Planned Community Whatever the adopted plan designates Eastern villages such as Otay Ranch

In the eastern villages, density and unit types are set by the planned community documents, not the R-zones; the city’s Otay Ranch GDP page notes a 2013 amendment that raised density in Village Six near a planned transit facility. New projects with complete applications on or after July 1, 2024 fall under the city’s inclusionary housing chapter, which exempts ADUs, remodels, density bonus units and mobile homes; rent-restricted inclusionary units must stay affordable for at least 55 years. For small-lot strategies, read our SB 9 lot split guide and the ADU investment guide.

Rent rules: state rent cap plus a local tenant protection ordinance

Rent cap. Chula Vista has no local apartment rent control that we found, and the Attorney General’s chart lists no San Diego County city. Covered units follow the Tenant Protection Act cap, which the Attorney General lists for the San Diego Area at 8.8% for increases starting August 1, 2025 and 8.2% for increases from August 1, 2026 through July 31, 2027. See our AB 1482 guide.

Just cause and relocation. The Residential Tenant Protection Ordinance, CVMC 9.65, requires just cause to end a tenancy and narrows the allowed grounds. The city’s landlord-tenant page says it was adopted November 1, 2022 and amended February 20, 2024, and that landlords must file a mandatory Owner Notice to City online. Under CVMC 9.65.070, a no-fault termination in a residential rental complex requires the greater of two months of HUD Small Area Fair Market Rent for the zip code or two months of actual rent, rising to three months for elderly or disabled tenants, regardless of income or tenure. Units outside a complex owe one month of rent. Payment, or a written rent waiver of equal value, is due within 15 days of the notice, and any slip voids the notice. If a withdrawn complex unit is re-rented within two years, the former tenant is owed six months. Compare with our just cause eviction guide.

Who is exempt. CVMC 9.65.040 exempts, among others, an owner-occupied duplex where neither unit is an ADU, owner-occupied single-family homes renting no more than two units or bedrooms, separately titled units not owned by a REIT, corporation or LLC with a corporate member if the required notice is in the lease, stays of 30 days or less and deed-restricted affordable housing.

Chula Vista rental property rules

Mobilehome space rents. Chapter 9.50 sets a space rent review system. Under CVMC 9.50.050, a park owner may raise space rent once per calendar year by the CPI change when it is 3% or less; above that, the allowed increase grows by only 75% of the CPI change beyond 3%. Larger increases go through the review and hearing process.

Short-term rentals. The STR ordinance allows a resident’s primary residence plus one more, a two-STR maximum, under a city license in Chapter 5.68. Investors cannot build a portfolio of vacation units in Chula Vista.

Business license. The city requires a business license for anyone carrying on business in city limits; confirm treatment of a rental building with Finance.

Building, utility and tax issues

Western Chula Vista has older apartment stock, so inspect laterals, framing and stairways, and for three or more units with elevated balconies, schedule SB 721 balcony inspections. Sewer billing depends on area: the city’s sewer page says Sweetwater Authority customers in the north get a city bill, southern Sweetwater customers pay on the property tax bill and Otay Water District customers pay on the water bill. Factor whichever applies into expenses. Eastern properties may carry CFD special taxes.

Underwriting a Chula Vista multifamily purchase

  1. Confirm the zone or planned community plan and match the legal unit count to permits.
  2. Check whether each tenancy is covered by CVMC 9.65 or exempt, and confirm the Owner Notice to City is on file.
  3. Model rent increases at or below the 8.2% state cap for covered units.
  4. Budget relocation exposure at SAFMR-based amounts before any planned renovation or withdrawal.
  5. Collect leases, the rent roll and two years of statements, and obtain estoppel certificates.
  6. Rebuild expenses with reassessed taxes, CFDs and the correct sewer billing path, using our rental property analysis.

Questions people ask

Does Chula Vista have rent control?

Not for apartments. State AB 1482 caps apply, but the city adds just cause and relocation rules, and mobilehome spaces have local rent review.

How much relocation do I owe on a no-fault eviction?

In a residential rental complex, the greater of two months of HUD Small Area Fair Market Rent or two months of rent, three months for elderly or disabled tenants, paid within 15 days.

Is my owner-occupied duplex exempt?

Generally yes, if you lived in one unit when the tenancy began and still do, and neither unit is an ADU or JADU.

What is the Owner Notice to City?

A mandatory online notice landlords submit under the tenant protection program; the city links the form from its landlord-tenant page.

Where are duplexes allowed?

R-2 is the city’s lowest-density multifamily zone and is aimed mainly at duplexes. R-3 allows apartment buildings, and planned communities set their own unit types.

How are mobilehome space rents capped?

Once per year by CPI up to 3%, plus 75% of any CPI change above 3%, with a hearing process for larger increases.

Can I run several short-term rentals in Chula Vista?

No. A resident may operate a primary residence plus one other STR, two total, with a city license.
