Multifamily and Duplex Properties for Sale in Poway: Zoning and Rent Rules

By Matthew Martinez, Founder, CEO & Managing Broker, Diamond Real Estate Group. California DRE #01869679.

Poway has little multifamily compared with its neighbors. Apartments are limited to the RA zone at up to 20 units per net acre, condominiums to the RC zone at 12, and newer housing is going into the Poway Road corridor plan. Proposition FF makes many density increases subject to a public vote. Rents fall under state law, and the Attorney General’s chart lists no local rent limit for Poway.

What multifamily in Poway looks like

Poway’s zone list is weighted toward rural and single-family zones (PMC § 17.06.010). Multifamily mostly means garden-style apartment complexes in RA, condominium communities in RC, mobile home parks, and new mixed-use projects along Poway Road. Small duplex and fourplex buildings are less common than in older South Bay cities, and adding an ADU is often the realistic way to get a second unit. For 2-4 unit purchases, see financing 2-4 unit properties. Apartment complexes need apartment building loans.

Where the zoning allows it

Zone Multifamily allowed Max density Min. lot Height
RA Residential Apartment Rental multiple dwellings (P); ownership units not allowed; mobile home parks by CUP 20 units/net acre 3 acres 35 ft / 2 stories
RC Residential Condominium Rental and ownership multiple dwellings (P); condo conversions by CUP 12 units/net acre 2 acres 35 ft / 2 stories
CO / CB / CG mixed use Dwelling units in a planned mixed-use project, by CUP Per CUP 10,000 sq ft 35 ft / 2 stories
Poway Road PC Mixed-use areas within the 235-acre plan Per specific plan — Per plan
MHP Mobile Home Park Mobile home park; within RA and RC, capped at 8 units/acre 8 units/acre — —

The minimum lot sizes (3 acres for RA, 2 for RC) rule out infill apartments on small lots. Parking requirements are heavy: the code table lists 3 spaces per unit in RC and 4 in RA, varying by unit size. Garages are required in every residential zone except RA. Single-family homes aren’t permitted in RA or RC, and the code doesn’t list duplexes as a separate use, so ask Development Services how a duplex would be treated (PMC §§ 17.08.100, 17.08.160).

Poway Road. The Poway Road Specific Plan’s environmental review projected about 1,148 net new homes along the corridor between Oak Knoll and Garden Roads (CEQAnet). That is where most new multifamily is likely to go.

ADUs and SB 9. ADUs are permitted in RA and RC as well as single-family zones. SB 9 applies on qualifying single-family lots, but check for hillside, fire and other constraints. The city has an ADU FAQ (City of Poway). See our SB 9 guide and ADU investment guide.

Proposition FF and density

Poway voters approved Proposition FF (Ord. 283) in November 1988 (Measure P materials). Under the code, a residential density increase in the South Poway Planned Community needs voter approval (PMC § 17.20.120). The city has described Prop FF as also requiring a public vote to rezone rural residential land to multifamily (City of Poway, 2005). In practice, a buyer can’t count on upzoning. Underwrite to the current zone, plus state ADU and density bonus law. Separately, PMC §§ 17.26.600–.610 contain the city’s affordable housing incentives.

Rent rules: state law only

The Attorney General’s rent cap chart lists no local limit for Poway. AB 1482 caps San Diego-area increases at 8.8% from August 2025 to July 2026 and 8.2% from August 1, 2026 to July 31, 2027 (AG rent caps). Exempt from the cap: buildings with a certificate of occupancy within 15 years, most single-family homes not owned by corporations, and owner-occupied duplexes. After 12 months, an eviction needs just cause (AG). See AB 1482 for landlords and just cause eviction.

Poway rental property rules

  • Mobile home parks. These need a CUP in RA and RC and are capped at 8 units per net acre or the zone maximum, whichever is lower (PMC § 17.08.100). State mobilehome law governs space tenancies, and AB 1482 generally doesn’t apply to them.
  • Condominium conversions. In RC, converting rental apartments to for-sale condos needs a CUP. In RA, conversions are prohibited, and so are individually owned units.
  • Business certificate. Ask the city’s business license office whether a residential rental needs one (City of Poway).
  • I found no rental registration program on official city pages. Confirm with the city.

Fire, slope and building issues

The code requires a registered civil engineer’s slope calculations in rural and some single-family zones, and generally won’t issue permits on lots under 4,000 sq ft (zoning overview). Before planning ADUs or SB 9 projects, check fire hazard mapping and insurance availability. For older apartments, review balcony and stair condition. Buildings with three or more units need SB 721 inspections (SB 721), and wood-frame tuck-under buildings deserve a seismic review.

Underwriting a Poway multifamily purchase

  1. Confirm the zone (RA, RC, commercial mixed use or a planned community) and check that the unit count fits 20 or 12 units per net acre.
  2. In RA, confirm all units are rentals. Individual unit ownership and condo conversion aren’t allowed.
  3. Confirm the certificate-of-occupancy date for AB 1482, and model the 8.2% cap.
  4. Don’t assume an upzone. Plan around ADUs and state density bonus law instead, because of Prop FF.
  5. Get estoppels and leases (estoppel certificates).
  6. Check parking compliance, then run the numbers (rental property analysis).
