Multifamily and Duplex Properties for Sale in Occidental: Zoning and Rent Rules

What multifamily in Occidental looks like

Occidental is a small unincorporated village, and its income property is mostly single-family homes with a second unit, cabins and cottages on wooded lots, apartments or manager units attached to inns and commercial buildings, and rural acreage with a guest house. True apartment buildings are uncommon. What usually limits adding units is not zoning density but sewer or septic capacity, steep terrain and the village’s historic district rules. For two to four units, read financing 2-4 unit properties; for a larger property, see apartment building loans.

Where the zoning allows it

Occidental is zoned under the county code. Section 26-08-020, enacted by Ordinance No. 6335 in 2021, sets these residential densities; confirm the district on each parcel record.

District County density Multifamily allowed? Occidental notes
AR Agriculture and Residential 1 to 20 acres per unit No AR with an RR 10 density designation appears near Joy Road
RR Rural Residential 1 to 20 acres per unit No Rural lots on wells and septic
R1 Low Density Residential 1 to 6 units per acre No; ADUs and SB 9 if eligible Check for any mapped village R1
R2 Medium Density Residential 6 to 12 units per acre Yes Requires sewer capacity in practice
R3 High Density Residential 12 to 20 units per acre Yes Rare in a village this size
K, C1 and other commercial Per the commercial use table Caretaker or mixed-use units as allowed The former Union Motel on K land includes a manager’s unit

Projects of four or more units. Section 26-08-050 adds design review before a building permit, 200 square feet of open space per rental unit, underground utilities, a water conservation plan and a ban on vacation rentals, timeshares and transient occupancy.

Historic district. Inside the Occidental Historic District, new buildings and exterior alterations, including ADUs and additions, must be consistent with the district’s adopted design guidelines and need Landmarks Commission approval, under Section 26-68-025.

ADUs and SB 9. State ADU law applies, subject to septic, sewer and fire access. Permit Sonoma limits SB 9 to single-family zones within a U.S. Census urban area, which a rural village may not satisfy; ask for a planner’s determination. See our SB 9 lot split guide and ADU investment guide.

Rent rules: state cap plus county just cause

State rent cap. The Attorney General’s rent cap page, updated July 16, 2026, places Sonoma County in the "All Other Counties" group, with a maximum of 8.6% for covered increases from August 1, 2026 through July 31, 2027. There is no local rent cap in Occidental.

Sonoma County Ordinance No. 6496. The county ordinance, passed September 17, 2024, applies across unincorporated west county, including Occidental.

  • Just cause at move-in. Protection starts with lawful occupancy rather than after a year.
  • Relocation. No-fault terminations require the greater of HUD Fair Market Rent for the unit size or the actual monthly rent.
  • Portal filing. Notices served on or after January 1, 2025 must be filed with the county within three days, and the landlord page requires English and Spanish informational materials for tenants with just cause protection.
  • Sale is not a ground. Notices must say that selling the property is not a valid reason for eviction.

See our AB 1482 guide and just cause eviction guide.

Occidental rental property rules

  • Vacation rentals. Occidental was not named in the county’s 2023 cap and exclusion rezoning, so standard Permit Sonoma rules apply: no vacation rentals in R1, R2 or R3 districts, in ADUs or in temporary structures such as yurts, and permits only in certain rural and commercial districts. Hosted rentals follow separate performance standards.
  • Transfer tax. The County Recorder charges $0.55 per $500 after assumed loans, with no city tax.

Sewer, septic and older buildings

The Occidental County Sanitation District dates to 1950, covers about 55 acres and has a 50,000-gallon-per-day secondary plant that irrigates in summer and discharges to Dutch Bill Creek from October to mid-May. Adding a unit inside the district depends on Sonoma Water approving a connection, and in 2021 the district and Graton agreed to study sending wastewater to Graton for treatment. A proposed lateral ordinance would let Sonoma Water require repair of failing laterals, so inspect the lateral before buying. Outside the district, septic design flow and replacement area set the unit count. Older wood-frame cottages may need seismic retrofit review, and any building of three or more units with elevated decks needs SB 721 balcony inspections.

Underwriting an Occidental multifamily purchase

  1. Confirm the zoning district and whether the parcel is inside the historic district.
  2. Verify that every unit is permitted; rural cottages and converted outbuildings are often not.
  3. Get sewer connection records from Sonoma Water, or septic permits from Environmental Health.
  4. Treat covered tenants as protected from move-in and budget the greater of Fair Market Rent or actual rent for any no-fault move-out.
  5. Collect leases, the rent roll and estoppel certificates.
  6. Rebuild expenses with reassessed taxes, wildfire insurance, septic or sewer costs and road maintenance in our rental property analysis.
