Commercial Real Estate in Walnut Creek: Core Area Zoning, Downtown Specific Plans and Linkage Fees

By Matthew Martinez, Founder, CEO & Managing Broker, Diamond Real Estate Group. California DRE #01869679.

Walnut Creek is central Contra Costa County’s main shopping and office center. Its commercial property concentrates in the downtown Core Area around Main and Locust streets and Broadway Plaza, in the office blocks between downtown and the BART station, and along North Main Street and Ygnacio Valley Road. The Shadelands Business Park sits to the east. The city zones downtown more tightly than most suburbs, with ground-floor retail rules and community benefit agreements for added height or floor area. Confirm the district, any specific plan and the zoning map height for each parcel.

Who controls the parcel

The City of Walnut Creek Community Development Department applies Title 10, Chapter 2, rewritten by Ordinance 1877 in 1996 and amended many times since. Heights in several districts are set on the zoning maps, not in the text.

Some "Walnut Creek" mailing addresses are unincorporated and follow Contra Costa County zoning. The Contra Costa Centre area at Pleasant Hill BART is also county land. See our Contra Costa County commercial page and check the assessor’s tax rate area.

The Core Area, downtown plans and Shadelands

Pedestrian Retail rules. In P-R, offices and communication facilities cannot occupy a ground floor that fronts a public street. Medical offices are not allowed, except an optometrist paired with eyewear sales. Banks need a conditional use permit and a finding that they will not interrupt pedestrian flow, and self-service laundries are excluded. Buyers of Main and Locust Street storefronts should underwrite to retail tenants only on the ground floor.

MU-C and MU-D standards. Core Area mixed-use districts require tall, deep ground floors: 18 feet within 50 feet of a Core Area retail street, and tenant spaces at least 50 feet deep, or 10 feet less than the lot depth if shallower. MU-C needs commercial space on at least half the ground floor and keeps surface parking at least 50 feet from Core Area retail streets. On those streets, the lower 40 feet of a building must leave a 15-foot public sidewalk.

West Downtown Specific Plan. This plan covers about 172 acres between BART and downtown, along Mount Diablo Boulevard, North California Boulevard, Olympic Boulevard and Ygnacio Valley Road. Its EIR studied up to 2,400 homes, 445,000 sq ft of office, 46,000 sq ft of commercial space and 176 hotel rooms. In this area, any building taller than 65 feet needs a community benefit agreement. MU-D and MU-C can reach FAR 3.0 with one.

North Downtown Specific Plan. The North Downtown plan EIR covered 191 acres, with about 899 homes and 3,546 jobs. MU-C height and FAR there follow the plan’s figures, and a CBA can add more.

Shadelands. The Shadelands Business Park has its own specific plan (SP-2). In 2014 the city approved the Shadelands Gateway Specific Plan for 25 acres at Ygnacio Valley and Oak Grove roads, rezoning business park land to a planned development. The city lists 16 specific plans in all, including North Main Street/Ygnacio Valley Road and Locust Street/Mt. Diablo Boulevard.

Linkage fees, alcohol and other local rules

  • Commercial linkage fee. Chapter 10-13, adopted in 2005 and amended in 2018, charges new commercial, R&D, hospital and care facility floor area a per-square-foot affordable housing fee, set by Council resolution. It is paid at building permit. Rebuilding destroyed or recently demolished space and parking structures are exempt, and nonprofit hospitals pay on half their new space.
  • Community benefit agreements. Article 17 of Part IV governs the agreements needed for added downtown height, FAR or density.
  • Alcohol and gasoline. Part III has separate articles on alcoholic beverage sales and on selling gasoline and alcohol together.
  • Cannabis. Article 14 of Part III regulates personal and commercial cannabis activities. We could not open its text, so confirm what is allowed with Planning.
  • Traffic impact fee. New development pays under Chapter 10-5.

Transfer tax, business tax and property tax

The Contra Costa Clerk-Recorder charges $0.55 per $500 in county documentary transfer tax, and lists added city taxes only for El Cerrito and Richmond. Walnut Creek’s Chapter 8-4, in effect since January 1, 1968, sets a city tax of $0.275 per $500, administered by the Recorder. Because no added Walnut Creek tax is listed, the city share appears to fall within the county total. Confirm with escrow.

Business licensing is in Chapter 8-6, and hotels pay transient occupancy tax under Chapter 8-3. We did not verify the rates. A sale is generally a Proposition 13 change of ownership.

Due diligence that matters in Walnut Creek

Begin with our commercial due diligence checklist, then add:

  • Confirm city versus unincorporated status.
  • Read the zoning map height for the parcel, which the text often defers to.
  • In P-R, confirm a proposed ground-floor tenant is allowed. Offices, medical and many banks are not.
  • Check whether the site is in the West or North Downtown plan and what a CBA would require.
  • Price the commercial linkage fee and traffic impact fee for any added floor area.
  • For older office buildings, review parking against current ratios and TDM rules.

Questions people ask

Can an office lease a ground-floor storefront downtown?

Not on a street-fronting ground floor in P-R. Offices are allowed upstairs or on interior ground floors.

How tall can downtown buildings be?

Height comes from the zoning map. In West Downtown, anything over 65 feet requires a community benefit agreement.

What FAR is allowed in MU-D?

At least 1.0, with a 1.5 base and up to 3.0 with a community benefit agreement.

Does new commercial space pay a housing fee?

Yes. Chapter 10-13 charges a per-square-foot linkage fee set by Council resolution.

What is the West Downtown Specific Plan?

A 172-acre plan for the area between BART and downtown.

Is there a city transfer tax?

Chapter 8-4 sets $0.275 per $500, but the Recorder lists no added tax beyond the county rate. Confirm with escrow.
