Commercial Real Estate in Rio Nido: What the Zoning Allows in a Residential River Community
By Matthew Martinez, Founder, CEO & Managing Broker, Diamond Real Estate Group. California DRE #01869679.
Rio Nido is a small unincorporated community on the north bank of the Russian River just east of Guerneville, built in steep canyons off River Road. It is overwhelmingly residential, so commercial opportunities are limited to a handful of parcels with commercial or visitor-serving zoning, legal nonconforming businesses, and home-based work. Sonoma County regulates every parcel through Permit Sonoma. Confirm the zoning and permit history of any Rio Nido property before treating it as commercial.
Who controls the parcel
Permit Sonoma applies the county zoning code; there is no city. Two special districts serve the community. Sewer comes from the Russian River County Sanitation District, whose service map shows a Rio Nido lift station, and water from the Sweetwater Springs Water District, which serves Guerneville, Monte Rio, Rio Nido and Villa Grande. Wildfire planning involves the state Board of Forestry and CAL FIRE as well as the county. For countywide context see our Sonoma County commercial guide.
Rio Nido zoning: mostly R1, with commercial to confirm
When the county reviewed vacation rentals in 2023, its staff report found that Rio Nido’s residential development is entirely zoned R1. That is the starting point for any commercial plan. The county’s commercial districts, defined in Section 26-10-020, are the ones to look for on a Rio Nido parcel record.
| District | Intended uses (county code) | Rio Nido notes |
|---|---|---|
| R1 Low Density Residential | Protects single-family neighborhood character | Covers Rio Nido’s residential development; commercial uses only as home occupations or legal nonconforming uses |
| K Recreation and Visitor-Serving Commercial | Recreation and tourist-commercial uses supporting the county’s recreational resources | The district that fits river lodges, cabins and restaurants; confirm whether any Rio Nido parcel carries it |
| LC Limited Commercial | Retail and services for daily needs in urban and rural areas | Possible for a small store; confirm |
| CR Commercial Rural | Mixed residential and commercial use in unincorporated communities, with discretionary review of new commercial uses | Possible for a mixed-use building; confirm |
A buyer of a Rio Nido "commercial" building should obtain the zoning, the use permit or proof of legal nonconforming status, and the date the use last operated, because a nonconforming use that stops may lose its right to restart under the county’s nonconforming use rules in Article 94.
Visitor-serving uses and vacation rentals
Rio Nido has long drawn summer visitors, but the county’s vacation rental rules mean that visitor housing there must come from properly zoned lodging rather than whole-home rentals. Permit Sonoma does not allow vacation rentals in R1, R2 or R3 districts, and the county’s District 5 fact sheet lists Rio Nido among areas where vacation rentals are prohibited by R-1 zoning, with a 7.1% concentration noted at the time. The staff report gave that as the reason Rio Nido needed no separate exclusion or cap zone. Hosted rentals, where the owner stays on site, follow separate performance standards.
For an investor, this makes any legally established lodge, inn or cabin resort zoned for visitor use comparatively scarce. Before buying one, confirm that its units are permitted as lodging and that it collects county transient occupancy tax.
Sewer, flooding and wildfire
- Sewer. The Russian River County Sanitation District began operating in 1983, covers about 2,700 acres and treats wastewater at a tertiary plant on Neeley Road in Guerneville with a design capacity of 710,000 gallons per day. Sonoma Water warns that atmospheric-river storms and high river flows can flood the collection system and cause overflows, it responded to a spill in January 2026, and it asks residents to keep cleanout caps secured. A $47.8 million state-funded headworks, lift station and force main project is expected to be finished by the end of 2030.
- Drainage. Rio Nido’s canyons have a history of county drainage work; for example, the county filed a negative declaration in 1998 for the Canyon Two storm drain project near Willow Road. Ask for drainage and slope reports on any canyon parcel.
- Flood. Parcels near River Road and the river should be checked against FEMA maps and the county’s F1 floodway and F2 floodplain combining districts.
- Wildfire. In October 2024 the Board of Forestry approved the Friends of Rio Nido vegetation treatment project, a 159-acre shaded fuel break along about 6.5 miles of ridgeline separating Rio Nido from the Fife Creek and Sweetwater Creek drainages, funded by a CAL FIRE grant to the county. Fire risk and access still drive insurance cost for any business property.
Transfer tax, business tax and property tax
The Sonoma County Clerk-Recorder charges $0.55 per $500 of value, after deducting assumed loans; Rio Nido is unincorporated, so no city tax applies. A purchase is generally a change in ownership under Proposition 13, so budget reassessment to the price. We did not verify county business license requirements.
Due diligence that matters in Rio Nido
Start with our commercial due diligence checklist, then add:
- Confirm the parcel’s zoning; if R1, document any legal nonconforming commercial use and when it last operated.
- Get a sewer account history and capacity confirmation from Sonoma Water for any added use.
- Check FEMA flood zone, F1 or F2 overlays and elevation certificates.
- Ask for slope, drainage and geotechnical reports on canyon lots.
- Confirm road access and parking, which are tight in Rio Nido’s canyons.
- For lodging, verify permits, TOT registration and occupancy limits.
