Commercial Real Estate in Comptche: Rural Zoning, Cottage Industry and What a Forest Hamlet Allows
By Matthew Martinez, Founder, CEO & Managing Broker, Diamond Real Estate Group. California DRE #01869679.
Comptche is a small hamlet about six miles inland from the Mendocino coast, on Comptche-Ukiah Road in a valley of timber, range and small farms. Commercial property here is rare. LAFCo describes a community hall, a store, a post office, a primary school and a church, and very little else. Most business activity takes the form of home-based work, farms and vineyards, timber operations and small rural services. This page explains what the county allows and how to check a specific parcel, which you should always do before buying.
Who controls the parcel
Comptche is unincorporated, so Mendocino County Planning and Building Services decides land use. The 2018 LAFCo fire sphere update is direct about this: the county makes land use decisions in the area, and the local district does not.
The Comptche Community Services District, formed in 1989, governs the Comptche Volunteer Fire Department and covers about 86.6 square miles. LAFCo estimates about 600 residents within that boundary, 159 of them in the hamlet itself. The district provides no water or sewer service, and no community system is described, so expect private wells, springs and septic systems. LAFCo also notes Comptche is not a disadvantaged community, which matters for state grant eligibility.
The county’s Zoning Display Map 44, printed in 2019 and marked as not an adopted map, covers Comptche, Comptche-Ukiah Road and Flynn Creek Road. Its legend includes rural residential, range, forest, timber production and rural community districts. Use the county’s zoning web map or a Letter of Zoning for the official answer. Check too whether a parcel near the coastal side falls within the Coastal Zone. See our Mendocino County commercial guide.
Comptche zoning for business and rural uses
The county’s inland districts are listed in Chapter 20.040. Those most likely to apply in and around Comptche are below.
| District | Intended uses | Notes |
|---|---|---|
| R-R Rural Residential (Ch. 20.048) | Large-lot homes with small-scale agriculture | An "L" suffix sets minimum density, such as RR-2 for 2 acres |
| R-L Rangeland (Ch. 20.060) | Grazing, resource production, watershed protection | Allows on-site processing and some ag-related commercial uses |
| F-L Forest Land (Ch. 20.064) | Forest resource land | Timber and compatible uses |
| TPZ Timberland Production (Ch. 20.068) | Growing and harvesting timber | 160-acre minimum. Other uses need a compatibility finding |
| A-G Agricultural (Ch. 20.052) | Crops, livestock and processing of products grown on site | Vineyards and orchards |
| R-C Rural Community (Ch. 20.084) | Mixed homes, shops and light industry | Where mapped. Lots without water or sewer need 40,000 sq ft |
A current county referral shows typical Comptche zoning. Case CC_2023-0008, dated February 8, 2024, covers 5.09 acres at 31351 and 31365 Comptche-Ukiah Road, west of Flynn Creek Road. It is zoned and designated Rural Residential with a 2-acre minimum. The parcels are in a State Responsibility Area for fire, with a moderate fire hazard rating. The owner is seeking conditional certificates of compliance to legalize a past land division. Old parcels in rural Mendocino may not be legal lots, so check this before you buy.
What business uses fit in Comptche
Home occupations and cottage industries. The inland code has a chapter for home occupations (Ch. 20.156) and one for cottage industries (Ch. 20.160). These are the usual routes for a studio, small shop, office, repair business or small food producer run from a rural property. Each sets limits on employees, floor area and customer traffic. Confirm the current limits and permit type with Planning before buying a property for a specific business.
Agriculture, vineyards and processing. The fire district review describes orchards, vineyards, row crops, ranchettes and large areas of forest and range. A-G and R-L allow processing of products grown on the premises, and some ag-related commercial use in R-L. Agricultural use types are defined in Chapter 20.032. For tasting, events or processing beyond your own crop, check the permit requirements for the specific district.
Timber. TPZ land is reserved for growing and harvesting timber, with a 160-acre minimum. Non-timber uses need a compatibility finding. TPZ also carries property tax treatment tied to timber use, so ask the Assessor before buying.
Combining districts. The inland code adds overlays such as Cannabis Accommodation (Ch. 20.118), Commercial Cannabis Prohibition (Ch. 20.119), Commercial Resort (Ch. 20.146) and the Special Minimum Lot Size "L" district (Ch. 20.132). Any of these can change what a Comptche parcel allows. The Letter of Zoning will list them.
Wells, septic, roads and fire
- Water and wastewater. With no community system described, plan on a private well or spring and a septic system. For any customer-facing use, Environmental Health will look at water supply and septic sizing.
- Fire protection. The CSD’s single station at 8491 Flynn Creek Road was built in 1976 and is described as in good condition but at capacity. Fire water comes from tenders, engine tanks, a portable tank and ponds, creeks, pools and cisterns. The district’s ISO rating is 6Y. Expect state fire-safe road, access and defensible-space rules on rural parcels in State Responsibility Areas.
- Lodging. Any short-term lodging collects county TOT under Chapter 5.20, with a registration certificate for each parcel, plus a Business Improvement District assessment through the Treasurer-Tax Collector.
- Cannabis. The county’s Cannabis Division issues cultivation licenses. Confirm overlays and license status before buying a property marketed for cannabis.
Transfer tax, business tax and property tax
The County Recorder collects documentary transfer tax and requires a Preliminary Change of Ownership Report with each deed. Its fee schedule does not post the rate, so confirm the amount on the escrow estimate. Comptche has no city, so no city tax applies. A sale generally triggers Proposition 13 reassessment, while TPZ and Williamson Act land is assessed under special rules.
Due diligence that matters in Comptche
Start with our commercial due diligence checklist, then add:
- Order a county Letter of Zoning to confirm the base district, any "L" lot size and overlays.
- Confirm the parcel is a legal lot, or budget for a certificate of compliance, as in CC_2023-0008.
- Test well yield and quality, and get the septic permit and an inspection.
- Confirm the permit path for your intended home occupation, cottage industry or ag use.
- Check fire hazard rating, road access standards and defensible-space work.
- Ask the Assessor about TPZ or Williamson Act status.
