Commercial Real Estate in Wilton: Agricultural Zoning, Wineries, Farm Stands and Rural Business Rules
By Matthew Martinez, Founder, CEO & Managing Broker, Diamond Real Estate Group. California DRE #01869679.
Wilton is a rural, unincorporated community in southeast Sacramento County, between Elk Grove and the Cosumnes River, made up mostly of agricultural-residential parcels of two to ten acres and larger farm holdings. "Commercial real estate" here usually means a farm with a stand, a small winery or tasting room, an equestrian or agricultural business, or a home-based enterprise on acreage, rather than a storefront. Confirm the zoning and any use permit for each parcel with Sacramento County Planning before relying on this page.
Who controls the parcel
Wilton has no city government. The Sacramento County Zoning Code applies, and County Planning handles rezones, parcel maps, use permits and design review. Recent County environmental filings place Wilton in the Wilton sub-area of the Cosumnes community, and the Cosumnes Community Planning Advisory Council, which reviews local land use applications before County hearings, meets at the Wilton Community Center on Colony Road. Its 2026 calendar lists meetings in June, July and September, with November and December dates scheduled and several months cancelled.
Fire and emergency medical service comes from the Wilton Fire Protection District, formed January 26, 1942, governed by a five-member board and based at 9800 Dillard Road. Its review matters for any building that will host the public.
One common point of confusion: the Wilton Rancheria’s 90.57-acre fee-to-trust commercial project, under Bureau of Indian Affairs environmental review in July and August 2026, is in the City of Elk Grove near Kammerer Road, not in the Wilton community.
Wilton zoning for commercial, agricultural and rural business uses
Wilton is mapped almost entirely in the County’s agricultural and agricultural-residential zones. Chapter 2 of the Zoning Code sets their purposes and minimum lot sizes.
| District | Intended uses | Notes |
|---|---|---|
| AG-20, AG-40, AG-80 Agricultural | Long-term farming; discourage premature urban conversion | 20, 40 or 80 acre minimum lots |
| AR-10, AR-5 Agricultural-Residential | Small farms, animal keeping and rural homes | 10 and 5 acre minimums; not single-family zones |
| AR-2, AR-1 Agricultural-Residential | Smaller rural lots | 2 and 1 acre minimums; agricultural processing barred |
| A-5 (interim) with F Flood combining | Holding zone used near the Cosumnes River | First floors elevated under the floodplain ordinance |
| LC Light Commercial, GC General Commercial | Retail and service commerce | Not typical in Wilton; a rezone would be needed on most parcels |
The district a parcel carries can change through a rezone. In a 2024 application near Dillard Road and Sherman Lane, the County reviewed rezoning about 20 acres from AG-80 to AR-5 and splitting it into four lots of about five acres, with a mitigated negative declaration circulated from December 20, 2024 to January 18, 2025. In 2019, a 10-acre AR-5 parcel on Gay Road near the Cosumnes River was proposed for a two-lot split with interim A-5 zoning and the Flood combining overlay.
Wineries, farm stands and agricultural businesses
The County’s use regulations in Chapter 3 are where Wilton’s business options really sit.
Small wineries (Section 3.4.8). Allowed in AG and AR zones on parcels of at least 3 acres with a state ABC license.
- Tasting. Wine or beer tasting is allowed up to five days a week, or more with a Minor Use Permit.
- Merchandise. Food and merchandise are limited to 15% of the tasting area.
- Events. Peak attendance scales with parcel size, from 50 people on 1 to 2.5 acres up to 350 on parcels over 20 acres, and outdoor events end by 7 p.m. Sunday through Thursday and 11 p.m. on Fridays, Saturdays and holidays.
- Production near homes. Producing more than 2,500 cases within half a mile of an RD residential zone needs a conditional use permit.
Large wineries under Section 3.4.9 avoid the production caps, but events in AG-20 and larger zones need a conditional use permit.
Farm stands (Section 3.4.7). Permitted by right in the AG, AR-10, AR-5 and AR-2 zones and by conditional use permit in AR-1.
- Size. One per parcel, with up to 1,500 square feet of indoor sales and 3,000 square feet enclosed.
- Events. Event attendance follows the same acreage scale as wineries.
Processing and stables. Agricultural processing is permitted by right up to 5 acres in AG zones and up to 1 acre in AR-5 and AR-10, needs a conditional use permit above those sizes, and is prohibited in AR-1 and AR-2. Commercial stables need at least 3 acres.
Wells, septic, flood and rural infrastructure
Wilton parcels generally rely on private wells and septic systems; the 2024 Dillard Road project proposed a separate well and septic system for each new lot, and the Gay Road review listed septic, drainage, wetlands and riparian habitat among its issues. For a business use, septic capacity and water quality are often the real ceiling: a tasting room, event space or farm stand with restrooms may need a larger or engineered system and County Environmental Management approval.
Parcels near the Cosumnes River can carry the County’s F Flood combining zone, which requires new or altered habitable buildings to have first floors elevated under the County’s floodplain ordinance. Road access, parking and fire district review also apply to anything that brings visitors.
Transfer tax, business tax and property tax
Wilton is outside the City of Sacramento, so only the County’s documentary transfer tax of $0.55 per $500 applies, less assumed loans. Businesses in the unincorporated area need a County General Business License; the County lists the fee at $262.60 for three years from July 1, 2026. A change of ownership generally triggers Proposition 13 reassessment, and farmland under a Williamson Act contract may have separate restrictions; check the title report.
Due diligence that matters in Wilton
Start with our commercial due diligence checklist, then add:
- Confirm the AG or AR district, any F Flood overlay and any pending rezone on the County zoning map.
- For a winery, confirm parcel size, ABC license type, tasting days and the event attendance allowed by acreage.
- Have the well tested and the septic system inspected and sized for the intended business use.
- Check whether the parcel is under a Williamson Act contract.
- Ask the Wilton Fire Protection District about access and fire flow for public-facing buildings.
- Expect proposals to go before the Cosumnes CPAC.
