What multifamily in Redwood Estates looks like

Redwood Estates, an unincorporated mountain community off Highway 17 above Los Gatos, is a neighborhood of houses and former cabins on wooded, sloping lots. It has no apartment buildings. Income property here means renting a house, adding an ADU or JADU, or buying a home that already has a permitted second unit. Some older properties also have extra units of uncertain legal status. The return on a Redwood Estates rental depends less on zoning density and more on whether the septic system, water supply, access road and fire safety can support another household. For small-property lending, see financing 2-4 unit properties. Apartment building loans apply to purchases in the valley cities instead.

Where the zoning allows it

The County’s rural districts in Chapter 2.20 govern the mountains. Redwood Estates lots are typically Hillside (HS) or Rural Residential (RR); check the zoning map for each parcel.

Housing type RR Rural Residential HS Hillside Notes
Single-family home By right By right
ADU and JADU By right By right No rentals under 30 days
Urban Primary Unit (County SB 9) By right, up to four units per parcel with ADUs Not listed State says HS should qualify
Movable tiny home Planning clearance Planning clearance
Small emergency shelter By right Not listed
Duplexes, apartments Not allowed Not allowed Only on -os housing opportunity sites

Density. New lots in RR follow a slope-density formula of 5 acres per home on gentle land up to 20 acres on slopes of 50% or more, and HS runs from 20 to 160 acres. Many Redwood Estates lots are far smaller than that, so new lot splits are unlikely outside SB 9. Existing undersized lots generally keep their right to one home.

SB 9 and the Urban Primary Unit. The County’s SB 9 tool lets RR parcels hold a second primary unit, with a four-unit cap once ADUs are counted. In its June 24, 2025 letter, the state housing department told the County to extend eligibility to HS, align its fire hazard exclusion with SB 450 and make its septic and water standards objective. It also said the 180-day minimum rental term should be 30 days. Each of those points bears on Redwood Estates. Check whether the County has amended its rules. See our SB 9 lot split guide and ADU investment guide.

Rent rules: state law and County protections

The Attorney General’s rent cap page, updated July 16, 2026, lists no local rent ordinance for unincorporated Santa Clara County. Covered rentals here follow AB 1482, at up to 8.6% for increases from August 1, 2026 through July 31, 2027. Single-family homes owned by individuals can be exempt with the required lease notice. See our AB 1482 guide.

Relocation for unsafe units. County Code Division C5 requires substitute housing, or three months of HUD fair market rent plus utilities, when a tenant must leave because of a vacate order or a condition-based eviction. The tenant also gets a right to return within 180 days of the unit becoming habitable. Fire, flood or earthquake displacements are excluded if the owner did not contribute and the tenant leaves within 90 days, which matters in a wildfire area.

Expanded tenant ordinance. Local press reported in June 2026 that the Board of Supervisors approved broader unincorporated tenant protections; we did not find adopted text on a County site, so confirm current terms. See our just cause eviction guide.

Redwood Estates rental property rules

  • Long-term only for ADUs. County ADU rules prohibit rentals shorter than 30 days, so an ADU is not a vacation rental.
  • Highway 17 scenic review. The County’s -sr district covers Highway 17 from Los Gatos to the Santa Cruz County line and Summit Road from Highway 17 to Mount Madonna County Park. A new unit within 100 feet of either needs design review.
  • Home occupations. Tenants and owners may run general home occupations by right.
  • Transfer tax. Only the County’s $0.55 per $500 applies; the Los Gatos town tax does not.

Septic, water, wildfire and older cabins

The County describes Hillside zoning as limiting development so it does not need public services, and the state’s 2025 letter flagged the County’s septic and water rules for SB 9. On a mountain lot, every new bedroom is a septic question, so get the septic permit history, a capacity review and the water provider’s will-serve position before you plan a unit. The County Fire Department’s hazard mitigation annex notes that much of its territory is in State Responsibility Areas and High or Very High Fire Hazard Severity Zones, which affects defensible space, building standards, insurance and SB 9 eligibility. Many older cabins were built before modern codes; have them checked for foundations, slope stability and seismic retrofit needs. SB 721 balcony inspections apply only at three or more units.

Underwriting a Redwood Estates rental purchase

  1. Confirm the parcel is unincorporated, its district and whether any second unit is permitted.
  2. Get septic, water and road records before valuing an ADU or SB 9 unit.
  3. Check the fire hazard zone and price insurance and defensible space work.
  4. Classify the tenancy under AB 1482 and model long-term rents only.
  5. Collect leases and estoppel certificates.
  6. Rebuild expenses, including insurance and septic maintenance, in our rental property analysis.

Questions people ask

Can I build a duplex in Redwood Estates?

Not as a conventional duplex. On RR land, the County’s Urban Primary Unit rules allow a second primary home under SB 9, and ADUs are allowed by right.

Can I rent my ADU to vacationers?

No. County rules require ADU rentals of at least 30 days.

Is there rent control in Redwood Estates?

No local ordinance. AB 1482 applies to covered units, at up to 8.6% from August 1, 2026.

What usually stops an ADU project here?

Septic capacity, water supply, steep slopes and fire access, more often than zoning.

Does wildfire affect SB 9 eligibility?

It can. The state asked the County to align its fire hazard exclusion with SB 450, so check the parcel’s hazard zone and the County’s current rules.

Does the Los Gatos transfer tax apply?

No. Redwood Estates is unincorporated, so only the County tax applies.

Local service evidence for a Redwood Estates rental property

A rental-property file should account for community services as well as unit condition:

  • The County Fire Department’s announcement identifies Redwood Estates as a community served by the new Redwood station opened October 30, 2024. Confirm the property’s actual response and access requirements with the department.
  • RESA reports Firewise USA participation since 2020, spring and fall chipping events, seasonal road-edge fuel removal, and SCCFD preparedness workshops at the Pavilion. Ask who performs and pays for work on the subject property. Community participation alone does not certify a rental building or determine its insurance terms.
  • November 2024 RESA notices describe SJWC water-service switching, scheduled interruptions and detours. They establish a local utility-project history; they do not establish current outages or service to every parcel. Obtain the subject building’s provider confirmation, current bills and any outstanding utility or access work before projecting rental operating costs.
