Commercial Real Estate in Redwood Estates: Mountain Zoning, Highway 17 Scenic Rules and Home Businesses

By Matthew Martinez, Founder, CEO & Managing Broker, Diamond Real Estate Group. California DRE #01869679.

Redwood Estates is an unincorporated residential community in the Santa Cruz Mountains off Highway 17, between Los Gatos and the Santa Cruz County line. It is almost entirely homes on wooded hillside lots. Commercial activity in and around it means home businesses, a handful of rural-district uses such as bed and breakfasts or retreats on larger parcels, and any older business with legal nonconforming status. The practical limits are as much about septic, water, roads and wildfire as about zoning. Confirm the district, overlays and service providers for any parcel with the County of Santa Clara Department of Planning and Development before you commit.

Who controls the parcel

Redwood Estates is outside any city, so the Santa Clara County Zoning Ordinance applies. The Town of Los Gatos, the nearest city, regulates only land inside its limits, and Santa Cruz County takes over at the ridge to the south. Water, fire and road services in the mountains come from a mix of providers, so ask the seller which water system serves the parcel and whether the road is County-maintained or private. For countywide rules, see our Santa Clara County commercial guide, and for the nearest commercial districts, our Los Gatos commercial page.

Redwood Estates zoning: what business use is possible

The County’s mountain communities are zoned under the rural districts in Chapter 2.20, most often Hillside (HS) or Rural Residential (RR); check the zoning map for each lot.

Use HS Hillside RR Rural Residential Notes
Home occupation, general By right By right One nonresident employee; about three visitors a day
Home occupation, expanded Special permit Special permit One-acre minimum; 1,200 sq ft accessory space
Bed and breakfast inn Use permit Use permit Stays limited to 14 days in any 30
Camps and retreats Use permit Use permit
Small winery By right By right Larger wineries need special or use permits
Local-serving retail Use permit Not allowed
Restaurants and bars, up to 1,200 sq ft Use permit Not allowed
Commercial kennels, stables Use permit Use permit

What this means here. Because many Redwood Estates lots are small, the uses that need an acre or more, such as expanded home occupations, are often out of reach. Most business activity in the community will be a general home occupation. Under Chapter 4.10, that means the work stays inside the home, with one unlit sign of a square foot and a single light truck or van. Auto repair, commercial food preparation other than cottage food, and medical, veterinary or massage services are prohibited.

Highway 17 and Summit Road scenic rules

The County’s -sr scenic roads district designates Highway 17 from the Los Gatos town boundary to the Santa Cruz County line, and Summit Road from Highway 17 to Mount Madonna County Park. Both run near Redwood Estates. Within 100 feet of either right-of-way:

  • Design review. Any structure, including signs, needs design review, and buildings in that band cannot get exemptions. Additions may be exempt only if they come no closer to the road than the existing building.
  • Signs. Each lot may have one on-site sign of up to 16 square feet plus one sale or lease sign, with steady, constant illumination.
  • Practical effect. A roadside business sign or a new building near Highway 17 goes through design review even when the use itself is allowed.

Septic, water, roads and wildfire

These are the controlling constraints in Redwood Estates.

  • Hillside purpose. The County says Hillside zoning keeps mountain land in open space, avoids natural hazards and limits development so it does not need public services. Any customer-facing use will be judged against that.
  • Septic and water. The state housing department’s June 2025 letter on County housing rules singled out septic and water availability standards. That reflects how often onsite systems and water supply limit what can be built in areas like this. A business that adds visitors or employees may need a larger septic system.
  • Wildfire. The County Fire Department’s hazard mitigation annex says much of its service area lies in State Responsibility Areas and High or Very High Fire Hazard Severity Zones, with CAL FIRE sharing responsibility there. Check the parcel’s hazard zone, access road width and insurance before planning any public-serving use.
  • Slopes. Rural Residential uses a slope-density formula of 5 to 20 acres per home, and Hillside 20 to 160 acres, so many existing small lots are legal nonconforming and cannot be split.

Transfer tax, business tax and property tax

The County’s real property transfer tax is $0.55 per $500 of consideration, excluding assumed liens. Unincorporated transfers go entirely to the County, and the Los Gatos town tax does not apply. Bed and breakfast stays owe County transient occupancy tax under Chapter V of the taxation division; we did not verify the rate. We did not find an unincorporated business license tax. A change of ownership generally triggers Proposition 13 reassessment.

Due diligence that matters in Redwood Estates

Start with our commercial due diligence checklist, then add:

  • Confirm the parcel is unincorporated Santa Clara County, not Los Gatos or Santa Cruz County.
  • Look up the base district and whether the -sr overlay applies near Highway 17 or Summit Road.
  • Identify the water provider and get septic records and capacity.
  • Check the fire hazard zone, road maintenance status and evacuation access.
  • For any existing business, confirm whether it is permitted or legal nonconforming.
  • Keep a home business within the general home occupation limits unless you have an acre or more.

Questions people ask

Is there commercial zoning in Redwood Estates?

We have not verified the mapped district for every Redwood Estates parcel. Confirm the exact zoning and the proposed use with Santa Clara County; a rural zoning use table does not establish the zoning of a specific lot.

Can I run a business from my Redwood Estates home?

Yes. A general home occupation is allowed by right, with one nonresident employee, about three visitors a day and one small unlit sign.

Can I open a bed and breakfast?

With a use permit in HS or RR. Guests are limited to 14 days in any 30, rooms cannot have kitchens, and septic and fire access must support the use.

Is Highway 17 a scenic road?

Yes, from the Los Gatos boundary to the Santa Cruz County line, so structures and signs within 100 feet need design review.

What limits development most in Redwood Estates?

Usually septic capacity, water supply, steep slopes and wildfire access rather than the use list.

Does the Los Gatos transfer tax apply?

No. Only the County’s $0.55 per $500 applies to unincorporated property.

Redwood Estates service records to add to a business-property file

The local service record is more specific than a general mountain-area description:

  • The Santa Clara County Fire Department announced the new Redwood fire station opening on October 30, 2024, and specifically named Redwood Estates among its communities served. Ask the department to review access and operational needs for the proposed business.
  • RESA’s fire-safety program identifies Redwood Estates as a Firewise USA participant since 2020. RESA describes spring and fall chipping events, seasonal roadside fuel work, and SCCFD-led preparedness workshops at the Pavilion. Those community activities do not establish the hazard classification, insurance eligibility or compliance of a particular building.
  • RESA’s November 2024 water-main notices document SJWC service connections, planned water interruptions and traffic detours on named community streets. They are historical project evidence, not current closure notices. For a customer-facing business, obtain today’s water-service confirmation and road-access arrangements rather than assuming uninterrupted delivery access from a mailing address.
