Multifamily and Duplex Properties for Sale in Monte Rio: Zoning and Rent Rules
What multifamily in Monte Rio looks like
Monte Rio’s rental housing is a mix of river cabins and cottages, older homes with second units, small groups of cabins on one parcel that date from the town’s resort era, and a few duplexes and small buildings near the town center. Many sit on steep wooded lots or in the Russian River floodplain. For an investor, the defining issues are floodplain rules, septic capacity, the county’s 5% vacation rental cap and county tenant protections. For two to four units, read financing 2-4 unit properties; for anything larger, see apartment building loans.
Where the zoning allows it
The county code’s residential districts set density, and Monte Rio parcels also carry overlays. The Planning Commission’s 2023 Monte Rio resolution listed parcels with codes such as RR B6, RRD B6 160, LG/116, VOH, SR and RC.
| District or overlay | What it means for rental housing in Monte Rio | Source |
|---|---|---|
| RR Rural Residential | 1 to 20 acres per unit; single homes, ADUs; no multifamily | County code; Monte Rio parcel list |
| RRD Resources and Rural Development | Resource land at very low density (B6 160 noted on some parcels) | Monte Rio parcel list |
| R1, R2, R3 (where mapped) | 1 to 6, 6 to 12 and 12 to 20 units per acre; multifamily only in R2 and R3 | County code |
| K Recreation and Visitor-Serving Commercial | Resorts and cabins; housing only as the commercial use table allows | 2026 Monte Rio file |
| F2 Floodplain | Floodplain building rules for new and improved structures | 2026 Monte Rio file |
| LG/116, LG/RRC, SR, VOH, RC | Highway 116 and Russian River Corridor guidelines, scenic, oak and riparian rules | Parcel list and 2026 file |
| X5 Vacation Rental 5% Cap | Caps vacation rentals at 5% of developed residential parcels | 2023 resolution |
Older cabin groups. Multiple cabins on one lot may be legal nonconforming, permitted as a resort, or unpermitted. Get the permit history before counting them as rentable units.
Four or more units. Section 26-08-050 requires design review, 200 square feet of open space per rental unit, a water conservation plan and no vacation or transient use for multifamily projects.
ADUs and SB 9. State ADU law applies, subject to septic and access. Permit Sonoma applies SB 9 only to single-family zones in a U.S. Census urban area; whether a Monte Rio parcel’s zone counts and whether it lies in a Census urban area must be confirmed by a planner, and many may not qualify. See our SB 9 lot split guide and ADU investment guide.
Rent rules: state cap plus county just cause
State rent cap. The Attorney General’s rent cap page, updated July 16, 2026, puts Sonoma County in the "All Other Counties" group, with a maximum of 8.6% for covered increases from August 1, 2026 through July 31, 2027.
Sonoma County Ordinance No. 6496. The ordinance, passed September 17, 2024, covers unincorporated river communities including Monte Rio.
- From the start. Just cause applies from the beginning of lawful occupancy.
- Relocation. The greater of HUD Fair Market Rent for the unit size or the actual monthly rent, for no-fault terminations.
- Three days. File notices served on or after January 1, 2025 through the county portal within three days of service, per the landlord page.
- Sale is not cause. Termination notices must say a sale is not a valid ground.
- Countywide emergencies. Section 8 of the ordinance has emergency protections that can extend countywide, which matters in a flood-prone town; read it before serving notices after a declared disaster.

Monte Rio rental property rules
- 5% vacation rental cap. The 2023 resolution added the X5 cap to Monte Rio parcels, finding that about 12.1% of single-family parcels were vacation rentals against 4.5% countywide, and citing limited parking, limited evacuation routes and loss of housing stock. The county staff report explains a 5% cap as one vacation rental per 20 developed residential parcels. With Monte Rio over the cap, buyers should not assume a new permit; underwrite long-term rents unless a valid permit exists and the county confirms how it transfers.
- Countywide limits. Permit Sonoma bars vacation rentals in ADUs, R1 to R3 districts and temporary structures.
- Transfer tax. The County Recorder charges $0.55 per $500 after assumed loans; no city tax applies.
Flood, septic and water
- Floodplain. F2 parcels must meet county floodplain rules; check FEMA zones and elevation certificates, which drive insurance and what can be rebuilt.
- Wastewater. Monte Rio is not shown on the Russian River County Sanitation District map, and a 1999 sewer study for 616 central parcels reached only a draft EIR. Septic capacity usually caps the unit count.
- Water. Sweetwater Springs Water District serves Monte Rio.
- Buildings. Older cabins on posts or hillsides may need seismic retrofit review, and buildings of three or more units with elevated decks need SB 721 balcony inspections.
