Commercial Real Estate in Occidental: Historic District Rules, Visitor-Serving Zoning and a Small Sewer System

By Matthew Martinez, Founder, CEO & Managing Broker, Diamond Real Estate Group. California DRE #01869679.

Occidental is a small unincorporated village in the redwood hills of west Sonoma County, and its commercial property is a short main street of restaurants, inns, shops and galleries, plus rural businesses on the surrounding ranch and forest land. Almost every commercial decision in the village core runs through two county layers: visitor-serving commercial zoning and the Occidental Historic District. Confirm zoning, historic status and sewer capacity with Permit Sonoma and Sonoma Water before relying on this page.

Who controls the parcel

Permit Sonoma applies the county zoning code; there is no city. Inside the historic district, the county’s Landmarks Commission must approve exterior changes before a zoning permit issues, under Section 26-68-020. Sewer in the village is provided by the Occidental County Sanitation District, which Sonoma Water operates and whose board is Sonoma Water’s Board of Directors. Outlying parcels rely on wells and septic. For countywide context see our Sonoma County commercial guide.

Occidental zoning for commercial and visitor use

The county’s commercial districts are defined in Section 26-10-020, enacted by Ordinance No. 6335 on February 9, 2021. The ones most relevant to a village like Occidental:

District Intended uses (county code) Occidental notes
K Recreation and Visitor-Serving Commercial A blend of recreation and tourist-commercial uses that supports the county’s recreational resources Mapped on the former Union Motel site near Main Street and Occidental Road
HD Historic (combining) Design review layer for historic structures and areas; base-zone uses unchanged Occidental is one of three districts with adopted design guidelines
SR Scenic Resources (combining) Added siting and design review in scenic areas Shown with K and HD on the Union Motel parcel
C1 Neighborhood Commercial Retail, service and professional uses in rural neighborhoods and urban service areas Check the parcel record for village storefronts
CR Commercial Rural Mixed residential and commercial uses in rural communities, with discretionary review of new commercial uses Typical of small county villages; confirm whether mapped
AR and RR Rural residential land; home-based businesses only as the code allows AR with RR 10 density appears near Joy Road

The Occidental Historic District

Section 26-68-025, added by Ordinance No. 6020 on March 12, 2013, requires that alterations to existing buildings and construction of new buildings in the Occidental, Bodega and Freestone historic districts be consistent with each district’s design guidelines adopted by the Board of Supervisors.

  • Landmarks Commission approval. Exterior alterations, including demolition, and new construction in the district need Commission approval before a zoning permit. Staff can approve minor alterations that conform to the guidelines.
  • Demolition timeline. The Commission must act on a complete demolition application within six months.
  • Uses unchanged. The HD overlay does not change what uses the base zone allows; it controls how buildings look and change.
  • Appeals. Commission decisions can be appealed to the Planning Commission and then the Board of Supervisors.

For a buyer, this means a facade change, new sign structure, addition or replacement building on Main Street should be priced with historic design review time, and possibly with materials and details the guidelines require.

Inns, restaurants and the former Union Motel

Lodging and food service are the core of Occidental’s commercial economy, and the K zone is built for them. A January 2026 county filing for the former Union Motel, a vacant 13-unit motel (12 guest rooms and a manager’s unit) on a 1.02-acre parcel zoned K with HD and SR overlays, treated its remodel and return to use as exempt from full environmental review. The project added no guest units, no height and no new impervious surface. The takeaway is that reopening an existing, legally established inn or restaurant within its footprint can be a simpler path than expanding one, which may trigger new historic, septic or sewer, parking and environmental review.

Whole-home vacation rentals are a separate county permit. Occidental was not among the areas named in the county’s 2023 cap and exclusion rezoning, so standard Permit Sonoma vacation rental rules apply: no vacation rentals in R1, R2 or R3 districts or ADUs, and existing homes in C2, LC and K may qualify with a permit. Confirm the parcel’s zoning string for any X or cap combining district.

Sewer: a small district with limits

  • Size. The Occidental County Sanitation District began operating in 1950, serves about 55 acres and provides secondary treatment with a design capacity of 50,000 gallons per day.
  • Discharge. Treated water is used for irrigation on private property from May 15 to September 30 and discharged to Dutch Bill Creek from October 1 to May 14.
  • Future options. In 2021 the district and Graton agreed to study transporting untreated wastewater to Graton for treatment and disposal.
  • Laterals. Sonoma Water describes a proposed sewer lateral ordinance that would let it inspect and require repair of failing laterals, without a point-of-sale inspection; it was described as proposed, not adopted.

A restaurant or inn expansion in the village should start with a sewer capacity request, because the plant is small and connection approval is not automatic.

Transfer tax, business tax and property tax

The Sonoma County Clerk-Recorder charges $0.55 per $500 of value, after deducting assumed loans; Occidental is unincorporated, so no city tax applies. Inns collect county transient occupancy tax. A purchase is generally a change in ownership under Proposition 13, so budget reassessment to the price. We did not verify county business license requirements.

Due diligence that matters in Occidental

Start with our commercial due diligence checklist, then add:

  • Confirm whether the parcel is in the Occidental Historic District and get the design guidelines.
  • Pull the use permit history for any inn, restaurant or event use.
  • Request sewer capacity from Sonoma Water, or for outlying sites, septic design flow from county Environmental Health.
  • Check water source and fire flow; many surrounding properties rely on wells.
  • Check flood and landslide mapping near Dutch Bill Creek and on steep lots.
  • Confirm any vacation rental or hosted rental permits and whether they transfer.

We did not read the Occidental Historic District Design Guidelines themselves, the district boundary map, or zoning on individual Main Street storefronts; C1 and CR are listed as districts to check, not as confirmed in Occidental. The Graton study’s outcome and the lateral ordinance’s status were not verified.
