Commercial Real Estate in Lake County: Districts, Size Caps, Resort Commercial and Area Plans
By Matthew Martinez, Founder, CEO & Managing Broker, Diamond Real Estate Group. California DRE #01869679.
Lake County’s commercial property sits in small town centers around Clear Lake and along Highways 20, 29 and 175. The places include Lucerne and Clearlake Oaks on the north shore, Kelseyville and Upper Lake, Middletown and Hidden Valley Lake in the south, and the two cities, Clearlake and Lakeport. Resorts, lodging and wineries matter more here than office space. The county’s zoning ordinance is unusual because it sets permit levels by building size and operating hours. Check every parcel’s district, area plan and water and sewer source with the Community Development Department.
Who controls the parcel
| Area | Regulator | Our guide |
|---|---|---|
| City of Clearlake | City of Clearlake | Clearlake |
| City of Lakeport | City of Lakeport | Lakeport |
| Lucerne, Clearlake Oaks (Shoreline Communities Area Plan) | Lake County | Lucerne · Clearlake Oaks |
| Middletown, Hidden Valley Lake (Middletown Area Plan) | Lake County | Middletown · Hidden Valley Lake |
| Kelseyville, Upper Lake, Nice, Lower Lake, Cobb | Lake County (their area plans) | Kelseyville · Upper Lake · Lower Lake · Cobb |
The county’s plans page lists eight area plans: Cobb Mountain, Kelseyville, Lakeport, Lower Lake, Middletown, Rivieras, Shoreline Communities and Upper Lake-Nice. Water and sewer come from a patchwork of districts and private wells and septic, and that patchwork sets minimum lot sizes.
Lake County zoning for commercial, industrial and resort use
The county zoning ordinance (Chapter 21) uses three permit tiers: by right with a zoning permit, a minor use permit, and a major use permit. Within a district, the tier depends on floor area, hours and outdoor storage.
| District | Intended uses | Notes |
|---|---|---|
| C1 Local Commercial | Small retail and services for nearby homes | By right up to 2,000 sq ft per use, 6 a.m. to 10 p.m. Bars up to 2,500 sq ft by major use permit. 2 stories/30 ft |
| C2 Community Commercial | Broad retail, restaurants with alcohol, offices, clinics, motels; housing where services exist | By right up to 5,000 sq ft per use, no drive-thru. Larger uses, drive-thrus and quiet bars by minor use permit. 35 ft (40 ft multifamily) |
| CH Highway Commercial | Traveler services at highway intersections | Restaurants including drive-thru by right up to 3,000 sq ft. Bars and truck stops by major use permit. 2 stories/30 ft |
| CR Resort Commercial | Tourist recreation in scenic areas: lodging, restaurants, docks | Motels up to 15 units by right, 16–25 by minor permit, over 25 by major. 50% coverage, 35 ft |
| C3 Service Commercial | Service and heavier commercial | Article 20 |
| M1 Commercial/Manufacturing | Heavy commercial and light manufacturing on sites of 5 acres or less | By right enclosed up to 6,000 sq ft per use. Contractor yards and truck terminals by major permit. 45 ft |
| M2, MP, PDC | Heavy industrial, industrial park, planned commercial | Articles 22, 23 and 15 |
Town centers and area plans
Lucerne and Clearlake Oaks. The Shoreline Communities Area Plan (2009 Planning Commission draft) sets Community Growth Boundaries for both towns. In Lucerne, it envisions a lakefront commercial downtown and more varied businesses along 13th Avenue. Clearlake Oaks would get a pedestrian-oriented Plaza with no heavy commercial or industrial uses, while tourist commercial would stay across Highway 20. It names limited water and sewer as a constraint on growth.
Middletown. The Middletown Area Plan, adopted August 17, 2010, covers Middletown, Hidden Valley Lake, Anderson Springs and the Langtry/Guenoc Valley. It supports mixed-use buildings with homes above shops downtown, design guidelines for all new commercial building, and steering service commercial away from town centers. It records resident concern about fast food and chain stores.
Guenoc Valley. The county created a separate Guenoc Valley zoning district (GVD) through Ordinances 3150 and 3151. The ordinances and maps are posted on the zoning ordinance page.
Size caps, hours, cannabis and the waterway setbacks
- Hours and size. In C2, a use is by right only if it is enclosed, open 6 a.m. to midnight, has no drive-thru, and stays under 5,000 square feet. A 24-hour store or a drive-thru needs a minor use permit. In C1, the by-right window closes at 10 p.m. and the size cap is 2,000 square feet.
- Bars. Bars without amplified sound need a minor use permit in C2. With amplified music they need a major use permit, and in CH every bar needs a major use permit.
- Cannabis retail. August 2026 amendments (Ord. 3163) list retail cannabis sales as a minor use permit use in C1 and C2. Other cannabis license types are governed by Article 27.
- Riparian corridors. The Waterway combining district bars development within 30 feet of perennial streams and 20 feet of intermittent streams and adjacent wetlands, unless the Zoning Administrator grants an exception.
Transfer tax, business tax and property tax
The Lake County Assessor-Recorder fee schedule (effective January 2026) lists the documentary transfer tax at $1.10 per $1,000 and shows no city transfer tax. Lodging pays a 9% transient occupancy tax on stays of 30 days or less, collected by the operator. RV park and campground spaces are included. A sale generally triggers Proposition 13 reassessment. We did not verify a county business license tax.
Due diligence that matters in Lake County
Start with our commercial due diligence checklist, then add:
- Confirm city or county jurisdiction, the district, and the area plan.
- Check water and sewer. Minimum lots in C1, C2, CH and CR run 8,000 square feet with public water and sewer, 15,000 with one public service, and 40,000 with well and septic.
- Measure the tenant’s floor area and hours against the by-right, minor and major permit thresholds.
- For lodging, count units against the CR or C2 motel tiers and confirm TOT registration.
- Check stream and wetland setbacks under the Waterway district.
- For lakefront parcels, confirm dock and shoreline permits.
