Multifamily and Duplex Properties for Sale in Lake County: Zoning and Rent Rules

What multifamily in Lake County looks like

Lake County’s rental housing is mostly small. You will find duplexes and fourplexes in Clearlake, Lakeport and the lakeside towns, older motels and cottage courts converted to long-term rentals, many mobile home parks, and a few larger apartment complexes near services. Most of the north and east shore was subdivided early in the 20th century into small lots without modern water and sewer service, so infrastructure often limits density more than zoning does. See financing 2-4 unit properties and apartment building loans.

Where the zoning allows it

The county zoning ordinance allows two or more units in these districts:

District 2+ units Density Minimum lot (public water+sewer / one public / well+septic) Height
R2 Two-Family Up to five duplexes per project by right; more by major use permit 4,000 sq ft per duplex unit 8,000 / 15,000 / 40,000 sq ft 35 ft
R3 Multi-Family Duplexes to apartment buildings; 20+ unit projects by right under objective standards Set by lot size and open space rules 10,000 / 20,000 / 40,000 sq ft 45 ft (more by major use permit)
C2 Community Commercial Residential where services exist; upper-floor units 2,292 sq ft per duplex or multifamily unit 8,000 / 15,000 / 40,000 sq ft 40 ft multifamily
PDR Planned Development Residential Per adopted plan Per plan Per plan Per plan

R3 projects need 100 square feet of private open space per apartment, plus 300 square feet of recreation area per unit in projects over seven units. Townhouse, condo and timeshare groupings in R3 need a major use permit. In R2, one ADU or second unit is allowed on a lot. See our ADU investment guide. The district articles we reviewed do not set SB 9 standards, and many rural Lake County parcels may not qualify. Confirm before relying on a split. See our SB 9 lot split guide.

Water and sewer decide the math. On a well and septic, every one of these districts needs at least 40,000 square feet. A duplex lot that needs 8,000 square feet on public water and sewer needs five times that on a well and septic. The Shoreline Communities Area Plan notes that most north shore development uses septic and that clay and wet soils make leach fields hard. The Middletown Area Plan cites Anderson Springs’ lack of sewer as a limit on growth there.

Rent rules: state law only

The Attorney General’s rent cap page does not name Lake County, so it falls in the "All Other Counties" group. The cap there is 7.7% for increases from August 1, 2025, and 8.6% for increases from August 1, 2026 through July 31, 2027. The chart shows no local rent cap in the county. State just cause and relocation rules apply to covered tenancies. See our AB 1482 guide and just cause eviction guide.

Lake County rental property rules

Mobile home parks. Article 43 allows parks in R1-MH, R2, R3 and PDR, but only with a major use permit or specific plan. Parks need at least 5 acres and are capped at 10 spaces per acre, with minimum space sizes from 2,400 square feet for a single-wide to 4,400 square feet for a triple-wide. Converting or closing a park requires a Planning Commission use permit, a relocation plan and a conversion impact report. A vacancy rate of 20% or more triggers a notice to the Community Development Director. Existing parks may not meet today’s standards, so underwrite them as legal nonconforming.

Condo conversions. Article 44 requires a major use permit to convert apartments to condos, timeshares or co-ops in any district. Tenants must get state Map Act notices and mailed hearing notice.

Short-term rentals. In July 2026, the county announced an ad hoc committee of short-term rental owners to help draft regulations for unincorporated areas, with monthly meetings until a draft is complete. Stays of 30 days or less already owe the county’s 9% transient occupancy tax. Underwrite any vacation-rental income as subject to change.

Septic, fire and older buildings

Much of Lake County’s rental stock is old. Cottage courts and resort buildings can be decades old, and some sit on substandard subdivisions. Budget for septic inspection and possible replacement, well testing, and defensible space in the wildland areas around Cobb and the south county. Under the Waterway combining district, new work within 30 feet of a perennial stream or 20 feet of wetlands needs an exception. Buildings of three or more units with elevated balconies need SB 721 inspections. Older wood-frame structures may warrant a seismic retrofit review.

Underwriting a Lake County multifamily purchase

  1. Confirm the jurisdiction (Clearlake, Lakeport or county), the district and the area plan.
  2. Identify water and sewer sources, and test the legal unit count against the lot size those services require.
  3. Classify units under AB 1482 and model increases at or below 8.6%.
  4. For converted motels or cottage courts, confirm legal residential use, not transient lodging, and any TOT history.
  5. Collect leases, the rent roll and two years of statements, and get estoppel certificates.
  6. Inspect septic, wells, roofs and decks, and rebuild expenses with reassessed taxes in our rental property analysis.

Questions people ask

Does Lake County have rent control?

No. The Attorney General’s chart lists no local cap. Covered units follow AB 1482, at 8.6% from August 2026.

How many duplexes can I build in the R2 district?

Up to five per project by right, at 4,000 square feet of lot area per unit. More than five need a major use permit.

Are larger apartment projects allowed by right?

In R3, projects of 20 or more units are permitted by right or ministerially if they meet objective standards.

Why does a well and septic matter for unit count?

Minimum lot size jumps to 40,000 square feet with a well and septic, compared with 8,000 to 10,000 square feet on public water and sewer.

Can I open a new mobile home park?

Only in R1-MH, R2, R3 or PDR with a major use permit, on at least 5 acres and at no more than 10 spaces per acre.

Is the county regulating short-term rentals?

It is drafting rules. A committee of owners started meeting in mid-2026, and stays of 30 days or less already owe 9% TOT.
