What multifamily in Rutherford looks like

Rutherford is a vineyard community, not a neighborhood of apartment buildings. Napa County’s General Plan describes it as a small center on Highway 29 with shops, wineries, a post office and a grange hall, and it leaves Rutherford off the Land Use Map so new development stays minimal. Rental income here usually comes from a farmhouse with an ADU or JADU, a guest cottage, employee housing for a winery or vineyard, or an apartment in an older commercial building. Buyers who need true multifamily should look at St. Helena, Yountville or Napa. For small properties, see financing 2-4 unit properties and, for larger buildings elsewhere, apartment building loans.

Where the zoning allows it

Rutherford is unincorporated, so Napa County Title 18 and the County General Plan govern housing.

District or rule Housing allowed Key limits
AP Agricultural Preserve One single-family home per legal lot; ADUs and a JADU if Section 18.104.180 is met 40-acre minimum parcel on Agricultural Resource land (AG/LU-21)
AP employee housing Six or fewer farmworkers, or up to 36 group-quarters beds or 12 units for one household, without a use permit Larger farmworker housing and seasonal centers by use permit
AW Agricultural Watershed One home, ADUs, JADU, guest cottage, small farmworker housing 160-acre minimum on AWOS land (AG/LU-20)
Commercial zoning in place on February 1, 1990 Mixed residential-commercial uses the zoning allows Policies AG/LU-45 and -97
CL / CN A commercial ADU by use permit Deed-restricted for moderate-income or lower tenants

No density by rezoning. According to the Agricultural Preservation and Land Use Element, Measure J (1990) and Measure P (adopted by voters in 2008) require a public vote to convert agricultural land, and those policies hold until after December 31, 2058 unless voters extend them. The parcel rules allow 2-acre lots only for farm labor camps under set conditions.

Supportive housing and care homes. The AP chapter treats supportive and transitional housing as residential use and allows small residential care facilities by right. Medium and large facilities need a use permit.

ADUs. The County’s ADU page caps ADUs at 1,200 square feet and JADUs at 500, and flags inadequate water, groundwater overuse and failing septic as grounds for denial. See our ADU investment guide.

SB 9. Agricultural parcels outside urbanized areas generally do not qualify for SB 9 splits or duplexes. Confirm any specific lot with the County. See our SB 9 lot split guide.

Rent rules: state law only

Rent caps. The Attorney General’s rent cap page, updated July 16, 2026, places Napa County in All Other Counties. Covered units may rise up to 7.7% for increases from August 1, 2025, and 8.6% from August 1, 2026 through July 31, 2027. No Napa County jurisdiction appears on the AG’s chart of local rent ordinances. Single-family homes and some ADUs may be exempt from AB 1482 with proper notice, so classify each unit. See our AB 1482 guide and just cause eviction guide.

Workforce units. Housing provided to winery or vineyard employees often depends on employment and may fall under the state Employee Housing Act. Review any County conditions or recorded restrictions before treating those units as market rentals.

Rutherford rental property rules

  • Nightly rentals barred. Napa County Code Section 18.104.410 prohibits transient commercial occupancy of dwellings in all residential and agricultural districts, Rutherford’s vineyard parcels included.
  • 30-day covenant. The County requires an ADU owner to record that neither the ADU nor the main house will be rented for under 30 days before the ADU permit issues.
  • Visitor lodging. Lodging belongs in a commercial district; CL allows inns and B&Bs of up to 50 rooms only with a use permit.
  • Transfer tax. The County’s document transfer tax is $0.55 per $500, customarily paid by the seller, with no city tax.

Wells, septic, historic structures and the AVA

Wells and septic systems decide whether a Rutherford parcel can support a second or third unit, and wineries and vineyards share that groundwater. Test the well, inspect the septic and confirm wastewater capacity before counting a new unit. Older farmhouses, bunkhouses and converted barns should be checked for permits and seismic retrofit needs. The General Plan also allows reuse of landmark or National Register buildings restored to federal standards, which can include residential use where zoning permits. Any building of three or more units with elevated decks needs SB 721 balcony inspections.

The federal Rutherford AVA (27 CFR 9.133), effective August 2, 1993, spans the valley between Skellenger Lane and Zinfandel Lane. Vineyard and winery value usually dominates a Rutherford sale, so treat rental income as a supplement.

Underwriting a Rutherford income property

  1. Confirm zoning, General Plan treatment and legal lot status.
  2. Count only legally permitted dwellings, and pull permits for each ADU, cottage or farmworker unit.
  3. Separate employee housing from market rentals and read its conditions.
  4. Test water and septic capacity before adding a unit.
  5. Underwrite long-term rents, model covered increases at or below 8.6%, and collect estoppel certificates.
  6. Rebuild expenses with reassessed taxes and insurance in our rental property analysis.

Questions people ask

Are there apartment buildings in Rutherford?

Very few. The area is agricultural, off the Land Use Map, and new multifamily zoning would need a public vote.

How many dwellings can an AP parcel have?

One single-family home per legal lot, plus ADUs, a JADU and limited farmworker housing.

Can a winery house its workers on site?

Yes, within limits: housing for six or fewer employees, or up to 36 beds or 12 units, without a use permit, and more with one.

Is there rent control in Rutherford?

No local ordinance. Covered units follow AB 1482.

Can I rent a cottage to tourists?

No. The County prohibits transient occupancy of dwellings.

Can I split a vineyard parcel to add homes?

Generally not. Agricultural Resource land has a 40-acre minimum, and Agriculture, Watershed and Open Space land 160 acres.
