What multifamily in Middletown looks like
Middletown’s rental housing is small-scale. It is mostly duplexes and fourplexes near downtown, older cottages and apartments over shops on the main streets, mobile home parks, and a few small complexes inside the Community Growth Boundary. Since the 2015 Valley Fire, some lots have been rebuilt with new homes and ADUs. The Middletown Area Plan estimated 510 occupied housing units in the Middletown census area in 2006, so even a small building is a meaningful share of the market. For financing, see financing 2-4 unit properties and apartment building loans.
Where the zoning allows it
Middletown is unincorporated, so the Lake County zoning ordinance applies, guided by the 2010 area plan. The plan favors higher-density housing near town centers with good transit and services (p. 1-4), and housing above ground-floor shops downtown (p. 1-3).
| District | 2+ units | Density / lot size | Height |
|---|---|---|---|
| R2 Two-Family | Up to five duplexes per project by right. More by major use permit | 4,000 sq ft per duplex unit. 8,000 sq ft lot on public water and sewer, 40,000 on well and septic | 35 ft |
| R3 Multi-Family | Duplexes through apartments. 20+ unit projects by right under objective standards | 10,000 sq ft lot on public water and sewer, 40,000 on well and septic | 45 ft |
| C2 Community Commercial | Upstairs and mixed-use units where services exist | 2,292 sq ft per unit | 40 ft for multifamily |
| PDR Planned Development Residential | Per adopted plan | Per plan | Per plan |
The county’s 6th Cycle Housing Element names Middletown as a Growth Boundary community with multifamily parcels. It projects 46 very-low-income and 13 low-income units on Middletown sites (Table 2-5). It counted sites only where sewer and water are within 200 feet. Countywide, Medium Density Residential tops out at 9 units per acre and High Density at 10 to 19, and the element supports building R3 at the top of its range.
ADUs and SB 9. R2 allows one ADU or second unit per lot. See our ADU investment guide. The county articles we reviewed set no SB 9 standards, and parcels on wells and septic, in high fire hazard zones or in floodways may not qualify. Confirm before relying on a split and see our SB 9 lot split guide.
Rent rules: state law only
The Attorney General’s rent cap page does not name Lake County, so it falls under "All Other Counties." The cap is 7.7% for increases from August 1, 2025, and 8.6% from August 1, 2026 through July 31, 2027. The chart shows no local cap, and we found no county rent or just cause ordinance. State just cause and relocation rules apply to covered tenancies. See our AB 1482 guide and just cause eviction guide.
Middletown rental property rules
- Mobile home parks. Article 43 allows new parks in R1-MH, R2, R3 and PDR only by major use permit, on at least 5 acres and at no more than 10 spaces per acre. Closing or converting a park needs a Planning Commission use permit, a relocation plan and an impact report. The Housing Element (Policy HE-2.3) supports relocation assistance when parks convert.
- Condo conversions. Article 44 requires a major use permit and tenant notices.
- Short-term rentals. Stays of 30 days or less owe the county’s 9% transient occupancy tax. In July 2026 the county convened a committee to help draft STR rules for unincorporated areas, so treat vacation-rental income as subject to change.
- Transfer tax. $1.10 per $1,000 under the Assessor-Recorder fee schedule. No city tax applies.
Water, sewer, flood and fire
Domestic water in town comes from the Callayomi County Water District. The area plan reports that the state found the district’s water rights sufficient for buildout if infrastructure is funded, but also says water and sewer systems need improvement and expansion (pp. 3-7, 2-19). Sewer is treated at the Lake County Sanitation District plant at 20126 Highway 175, which was upgraded under a 2019 project covering headworks, aeration, disinfection, pond liners and backup power. Parcels outside those systems need at least 40,000 square feet per the zoning articles.
Much of the community area is in the 100-year floodplain, and the plan calls wildland fire a serious threat. Get flood elevations and insurance quotes early. For pre-2015 buildings, check rebuild history and defensible space. Older wood-frame buildings may warrant a seismic retrofit review, and buildings with three or more units and elevated balconies need SB 721 inspections.
