What multifamily in Blackhawk looks like
Blackhawk is a gated, master-planned community of single-family homes, golf course estates and some attached townhome and condominium villages. Traditional apartment buildings are essentially absent. For an investor, "multifamily" in Blackhawk usually means one of three things: a townhome or condo held as a rental, a single-family home with an ADU or junior ADU, or the long-term question of whether Blackhawk Plaza will ever add housing. Two-to-four-unit financing still applies to a home plus ADUs. See financing 2-4 unit properties and apartment building loans.
Where the zoning allows it
Blackhawk is unincorporated and was developed under Contra Costa County’s P-1 Planned Unit district. Under Article 84-66.4, P-1 land may be used for whatever the approved final development plan permits, provided it is consistent with the General Plan. One detached home is allowed on each legal lot. Where residential uses are approved, ADUs are allowed under Chapter 82-24, along with licensed supportive or transitional housing of up to six residents.
| Setting | What multifamily is possible | Notes |
|---|---|---|
| P-1 single-family neighborhoods | One home per lot, plus an ADU and junior ADU under state and county ADU law | HOA CC&Rs and design review also apply |
| P-1 townhome and condo villages | Units already built under the development plan | Adding density needs a plan modification |
| Blackhawk Plaza (General Plan Mixed-Use Medium Density) | 30 to 75 homes per acre, plus density bonus, per the county | No housing application filed as of the county’s update |
| SB 9 on single-family lots | Up to two units and a lot split where state criteria are met | Very high fire hazard areas and other exclusions can apply |
ADUs. P-1 approval of residential use brings ADU rights with it. In Blackhawk the practical limits are lot slope, HOA design review and fire access. See our ADU investment guide.
SB 9. Blackhawk’s hillside setting means some parcels may fall in very high fire hazard severity zones or other areas where SB 9 is restricted. Check each parcel. See our SB 9 lot split guide.
Blackhawk Plaza. The county says the plaza’s General Plan designation already allows commercial, residential or mixed development at 30 to 75 homes per acre. Recent state law may remove the need to rezone for some housing projects. The county notes a 1985 development agreement covering 45.54 acres, about 5.73 acres of open space dedicated to the homeowners association, and a separately owned museum parcel whose access would likely have to be maintained. Those all constrain any future residential plan.
Rent rules: state law only
The Attorney General’s rent cap page lists no local cap for unincorporated Contra Costa County. Covered Blackhawk rentals follow the Tenant Protection Act. Contra Costa is in the AG’s San Francisco Area region, where the cap is 6.3% for increases starting August 1, 2025 and 8.8% for increases from August 1, 2026 through July 31, 2027. Single-family homes and condos owned by individuals, not corporations or REITs, can be exempt from the cap and just cause rules if the lease includes the statutory notice. Most Blackhawk rentals are that type of property, so check the lease before assuming the cap applies. See our AB 1482 guide and just cause eviction guide.
Blackhawk rental property rules
- HOA rules. Blackhawk’s homeowners associations set leasing rules in their CC&Rs and governing documents, often including minimum lease terms and tenant registration. Get the current documents before buying.
- County services. LAFCO’s district roster lists County Service Area M-23 (Blackhawk area) and County Service Area P-2, Zone A (Blackhawk), which provide extended local services. Their charges may appear on the tax bill.
- Cannabis. Blackhawk is one of nine areas in the county’s cannabis exclusion district, so commercial cannabis activity is barred everywhere in the community.
- Short-term rentals. We did not verify county short-term rental rules. HOA documents may also bar stays under 30 days.
Hillside, fire and building issues
Blackhawk’s homes sit on rolling hills at the base of Mount Diablo. For an ADU or SB 9 project, get a geotechnical review, confirm fire department access and water flow, and check the fire hazard severity zone. Townhome villages with three or more units and elevated balconies or walkways need SB 721 inspections. Most stock dates from the 1980s onward, so soft-story seismic retrofit is less common, but tuck-under parking is worth checking.
Underwriting a Blackhawk multifamily purchase
- Confirm the parcel is in unincorporated Blackhawk, not the Town of Danville, and pull its P-1 development plan.
- Read the HOA CC&Rs for leasing restrictions, minimum terms and ADU design review.
- Check whether the unit is AB 1482 exempt (individual-owned single-family or condo with notice) or covered.
- Evaluate ADU or SB 9 potential against slope, fire zone and HOA limits.
- Collect leases and estoppel certificates from tenants and the HOA.
- Add HOA dues, CSA charges, reassessed property tax and the county transfer tax of $0.55 per $500 (Clerk-Recorder) in our rental property analysis.
Questions people ask
Are there apartment buildings in Blackhawk?
Very few. Blackhawk is mostly single-family homes and townhome or condo villages built under county P-1 development plans.
Does Blackhawk have rent control?
No local rent control. Covered units follow AB 1482, 8.8% for increases from August 1, 2026, and many individually owned homes and condos are exempt with proper notice.
Can I build an ADU in Blackhawk?
Generally yes. The county’s P-1 rules allow ADUs where residential use is approved, subject to HOA design review and site conditions.
Will Blackhawk Plaza become housing?
Its General Plan designation allows 30 to 75 homes per acre, but the county reported no housing application and does not expect one before the property sells.
Who regulates Blackhawk zoning?
Contra Costa County’s Department of Conservation and Development, under the P-1 district and approved development plans.
Is there a city transfer tax?
No. Blackhawk is unincorporated, so only the county tax of $0.55 per $500 applies.
