Multifamily and Duplex Properties for Sale in Benicia: Zoning and Rent Rules

What multifamily in Benicia looks like

Benicia’s income property is mostly small-scale: older homes converted to duplexes in the RM district, small apartment buildings and townhouses near First Street and the waterfront in RH, units over shops downtown and, more recently, sites rezoned for high-density housing in the Housing Opportunity Zone. Historic preservation rules affect much of the older stock. For two to four units, read financing 2-4 unit properties; for larger buildings, see apartment building loans.

Where the zoning allows it

Chapter 17.24 sets density by site area per unit, with smaller per-unit areas for affordable and senior housing.

District Multifamily Site area per unit (base) Height
RS Single-Family Not permitted; pre-July 1, 1977 duplexes to fourplexes may remain 6,000 sq ft 30 ft
RM Medium-Density Permitted, including converted duplexes and townhouses 3,000 sq ft (2,400 low/moderate income; 1,500 low-income senior) 35 ft
RH High-Density Permitted; apartments near First Street, the waterfront and commercial nodes 2,000 sq ft (1,000 low-income senior) 35 ft
HZ Housing Opportunity Zone Permitted; single-family not allowed 580 sq ft (about 75 units/acre) 72 ft; 20,000 sq ft minimum site
MU-I Mixed Use Infill Permitted with commercial 1,000 sq ft 40 ft, 3 stories
MU-L Mixed Use Limited Single-family to small multifamily 1,452 sq ft; four units on any lot legal as of February 22, 2022 35 ft, or 45 ft near I-780
CC, CO, CW Permitted, generally above ground-floor commercial Per FAR (1.2; 2.0 in the Arsenal historic district) 40 ft

By-right affordable sites. Qualifying projects on designated housing sites with at least 20% of units affordable to extremely low, very low or low-income households can be approved by right.

MU-L fourplex rule. Any MU-L parcel that legally existed on February 22, 2022 can hold four multifamily units regardless of size, a useful allowance for small lots near shops and transit.

Shoreline heights. West of First Street, within the first 150 feet of the shoreline, residential buildings are limited to 24 feet and two stories.

ADUs and SB 9. Under Chapter 17.90, compliant ADUs and JADUs are approved ministerially with no added parking. Detached ADUs can reach 1,200 square feet, and ADUs and JADUs must be leased for at least 30 days. ADUs are also exempt from historic overlay design review. SB 9 two-unit projects and lot splits can apply on qualifying single-family lots under state law; confirm the city’s standards. See our ADU investment guide and SB 9 lot split guide.

Inclusionary housing. Projects of 10 or more units must set aside 10% of market-rate units as affordable (15% for for-sale projects of 100 or more), split between low and moderate income for at least 55 years. Off-site or rehabilitation alternatives need an economic showing that on-site units are infeasible.

Rent rules: state law only

The Attorney General’s rent cap page, updated July 16, 2026, places Solano County in All Other Counties, with covered units allowed up to 8.6% for increases from August 1, 2026 through July 31, 2027, and lists no Solano County city with local rent stabilization. We found no Benicia rent or tenant protection chapter in the city code index, so Benicia apartments follow AB 1482’s cap and just-cause rules for covered units, with exemptions for buildings under 15 years old and qualifying individually owned homes. See our AB 1482 guide and just cause eviction guide.

Benicia rental property rules

  • Historic overlay. In an H district, exterior alterations, additions and demolitions need approval from the director or the Historic Preservation Review Commission before a building permit issues, and owners must keep exteriors in good repair. Demolition of a historic building can be delayed 180 days or more.
  • ADU leases. ADUs and JADUs cannot be rented for less than 30 days.
  • Vacant properties. Chapter 8.50 sets maintenance and registration rules for neglected, vacant and foreclosed properties.
  • Transfer tax. Benicia’s Chapter 3.16 sets $0.275 per $500, administered by the County Recorder. Under Solano County Code Sections 11-60 and 11-67, the county tax is $0.55 per $500 and is reduced by a half-rate city tax, so the combined charge should be $0.55 per $500; confirm in escrow.

Older buildings and historic stock

Much of Benicia’s small rental stock is in older homes, some converted to duplexes, as the RM district’s purpose statement anticipates. Older wood-frame buildings warrant a seismic retrofit review, and exterior repairs in historic districts may need design approval. Buildings of three or more units with elevated balconies or walkways need SB 721 balcony inspections. The ADU chapter says pre-2020 unpermitted units are not denied legalization for code issues unless they are substandard, which can help when legalizing an existing second unit.
