What multifamily in Encinitas looks like

Most Encinitas income property is small: duplexes on older lots in Old Encinitas, Leucadia and Cardiff, small apartment buildings near Highway 101 and downtown, and mixed-use buildings with units over shops. Large apartment projects are newer and concentrated on the city’s R-30 Overlay housing sites. Mobile home parks have their own MHP zone. Small-property buyers should start with financing 2-4 unit properties; for larger buildings, see apartment building loans.

Where the zoning allows it

Densities come from Chapter 30.16, and the use permissions from the use matrix.

Zone Maximum density (net) Minimum lot Notes
R-8 8 units per acre 5,400 sq ft Single-family zone
R-11 11 units per acre 3,950 sq ft Small-lot single-family
R-15 15 units per acre 20,000 sq ft Duplex allowed on older lots of 5,000 sq ft or more
R-20 20 units per acre 20,000 sq ft Multifamily
R-25 25 units per acre 20,000 sq ft Multifamily
R-30 Overlay 30 units per acre, minimum 25 30,000 sq ft At least 16 units; three stories, 35 ft flat roof
Downtown D-R11, D-R15, D-R25 and D-CM Plan-set Plan-set Duplexes in Residential East on lots of 5,000 sq ft or more

Density is measured on net acreage and fractions generally round down, except on R-30 Overlay and density bonus projects. On R-30 Overlay sites, average unit size is capped at 1,000 square feet for rentals and 1,150 square feet for ownership, a third story needs a 30-foot setback from existing single-family or duplex parcels, and affordable requirements cannot be met by fee. The voter-approved Right to Vote Amendment means any rezone that adds units usually needs an election, so value land on its current density. The R-30 Overlay housing sites and listed specific plan zones are exempt from its height cap. For lot splits and backyard units, see our SB 9 lot split guide and ADU investment guide.

Inclusionary housing. Chapter 30.41 requires projects of seven or more units to set aside 20% for low-income or 15% for very low-income households, rental or for-sale. Projects of six or fewer units, and additions of 500 square feet or more, must build an affordable ADU or pay an in-lieu fee. Even a small duplex rebuild can carry an affordability cost.

Rent rules: state law only

We found no Encinitas rent control or local just cause ordinance for apartments on official sources, and the Attorney General’s rent cap page lists no San Diego County city in its local chart. Covered units follow the Tenant Protection Act; the Attorney General lists the San Diego Area cap at 8.8% for increases starting August 1, 2025 and 8.2% for increases from August 1, 2026 through July 31, 2027. Owners may set the opening rent for a new tenancy. See our AB 1482 guide and just cause eviction guide.

Encinitas rental property rules

Short-term rentals. Under Chapter 9.38, every STR in a residential zone needs an annual city permit, $1 million of liability insurance and payment of transient occupancy tax. Non-hosted units need a three-night minimum; hosted units, where the owner stays on site or next door, do not. ADUs are excluded from the definition of a short-term rental. Permits are non-transferable, and a new owner must apply within 14 days of a change in ownership. Occupancy is capped at two people per bedroom plus one, street parking by guests is prohibited, and owners must answer complaints within an hour.

Mobile home parks. The MHP rules require a major use permit and a minimum of five acres. When an existing park is subdivided, the owner must document tenants and relocation costs and pay part of relocation costs for low- and moderate-income tenants moving within 100 miles.

Coastal, utility and building issues

The city’s Local Coastal Program was effectively certified in 1995, according to the Coastal Commission’s status chart, so the city issues most coastal development permits for additions and new units. Water and sewer differ by community: the city’s Housing Element assessment lists San Dieguito Water District for Old Encinitas and Leucadia and Olivenhain Municipal Water District elsewhere, and the Leucadia Wastewater District, Cardiff Sanitary Division or Encinitas Sanitary Division for sewer. Older beach-area duplexes deserve lateral video, corrosion checks on metal connectors and railings, and for three or more units with elevated balconies, SB 721 inspections.

Underwriting an Encinitas multifamily purchase

  1. Confirm the zone or specific plan, and whether the current unit count matches permits and density.
  2. Assume no added density through rezoning; Proposition A makes it a ballot question.
  3. Classify units under AB 1482 and model increases at or below 8.2%.
  4. If any STR income is claimed, confirm hosted or non-hosted status and that a new permit is obtainable.
  5. Collect leases and statements, and obtain estoppel certificates.
  6. Confirm water and sewer providers, budget inclusionary costs for any rebuild, and rebuild the numbers in our rental property analysis.

Questions people ask

Does Encinitas have rent control?

No local rent control was found for apartments. AB 1482 applies to covered units, with an 8.2% San Diego Area cap on increases from August 1, 2026.

Where are duplexes allowed?

R-15 allows a duplex on older lots of 5,000 square feet or more, and the Downtown plan allows duplexes in its Residential East subdistrict on similar lots. Higher zones allow multifamily.

What is the R-30 Overlay?

A housing overlay on identified sites that allows 25 to 30 units per acre on sites big enough for at least 16 units, with three stories and caps on average unit size.

Does a small project owe affordable housing?

Projects of six or fewer units, and additions of 500 square feet or more, must build an affordable ADU or pay an in-lieu fee.

Can I short-term rent a unit in a duplex?

With a city permit. Non-hosted rentals need a three-night minimum, and ADUs cannot be used as short-term rentals.

Does an STR permit transfer when I buy?

No. Permits are non-transferable, and a new owner must apply within 14 days.

Can I get more units by rezoning?

Rezoning that increases units is a major amendment that needs a public vote under the Right to Vote Amendment.
