House Hacking in the North Bay: Duplexes, ADUs and Room Rentals

House hacking means buying a home you live in and renting part of it, such as the other side of a duplex, an ADU or junior ADU, or a spare room, so the rent offsets your housing cost. In California, living on the property changes which tenant rules apply. An owner-occupied two-unit building is exempt from the state rent cap and just-cause rules, and a homeowner renting a room or a back unit is exempt from just cause. A single lodger who shares your home has a separate, simpler set of rules.

At North Bay prices, house hacking rarely makes a home free. It can make the payment manageable and give a first-time investor landlord experience in a building they can see from the kitchen. This guide compares the formats, the state rules behind each, the ADU and JADU limits, and a sample budget with every assumption stated.

Local ordinances can add rules on top of state law, so check the city or county for the address. Our AB 1482 guide for landlords covers each state exemption in more detail.

Financing: you have to actually live there

Owner-occupant loans are what make house hacking work, because they allow smaller down payments than investment-property loans. FHA, VA and conventional programs all finance owner-occupied homes of one to four units. Their down payments, loan limits and rules on counting rent are laid out in our guide to financing 2 to 4 unit properties.

Occupancy is a real obligation, not a box on the application. A June 2017 HUD Inspector General memo summarizes FHA’s requirement. The borrower must establish occupancy as a principal residence within 60 days after signing the security instrument, and keep living there for at least one year. Conventional and VA loans have their own occupancy terms, so read the loan documents and ask your lender how long you must stay.

Plan the exit at purchase. If you later move out and keep the property as a rental, the AB 1482 duplex exemption can fall away, because it requires the owner to keep living in one of the units.

Sharing your home: the tenant rules that change

Just cause exemptions for owner-occupants

Civil Code 1946.2, which requires just cause to end most tenancies after 12 months, doesn’t apply in three owner-occupant situations:

  • Shared kitchen or bath: housing where the tenant shares a bathroom or kitchen with an owner who lives there as their principal residence (subdivision (e)(4)).
  • Single-family homes: an owner-occupied single-family residence where the owner rents no more than two units or bedrooms, including an ADU or JADU (subdivision (e)(5)).
  • Duplexes: two separate units in one structure, where the owner lived in one at the start of the tenancy and still does, and neither unit is an ADU or JADU (subdivision (e)(6)).

The rent cap is narrower

Section 1947.12 limits increases to 5% plus the local change in the cost of living, or 10%, whichever is lower. Its owner-occupant exemption covers only the two-unit structure described above (subdivision (d)(6)). It has no exemption for renting a room in your own house.

A house or condo that can be sold separately is exempt from the cap only if the owner isn’t a corporation, REIT or LLC with a corporate member. The tenant must also have received the statutory exemption notice. Whether that exemption works for a unit on the same lot as an ADU is a question for a landlord-tenant attorney. Both sections are set to expire January 1, 2030.

One lodger in your home

Civil Code 1946.5 covers an owner-occupied home with a single lodger, someone renting a room or room and board, where the owner keeps access to all areas and overall control. Either side can end a periodic arrangement with written notice under the usual notice periods. After the notice runs, the lodger’s right to stay ends by operation of law, and removal can proceed under Penal Code 602.3 or other applicable law.

The rule applies only with one lodger. With two or more roommates, ordinary landlord-tenant law applies, so use a written lease and follow normal termination procedures. If you rent to a sitting tenant you inherited with the purchase, see buying a tenant-occupied property.

ADU and JADU rules that affect a house hack

State ADU law, now in Government Code sections 66310 and following, sets the floor for what cities and counties must allow.

  • No owner-occupancy requirement for ADUs: section 66315 bars local agencies from requiring an owner to live on a lot with an ADU. It does let them require that rentals be for terms of 30 days or longer.
  • JADU size and location: a junior ADU is no more than 500 square feet of interior living space, contained entirely within a single-family residence (section 66313).
  • JADU owner-occupancy: if the JADU shares sanitation facilities with the main home, the owner must live in either the main home or the JADU (section 66333). A recorded deed restriction must bar selling the JADU separately from the house, and rentals must run longer than 30 days.

Unincorporated Sonoma County

Permit Sonoma’s ADU rules, which owners sign with the building permit application, say an ADU may never be used as a vacation rental. They also bar offering it for stays of fewer than 30 successive days. The restrictions apply to owners and all successors in interest, so a buyer inherits them.

The county is also opening more parcels to ADUs. Its October 7, 2026 CEQA notice of exemption describes an ordinance removing the Z (Accessory Dwelling Unit Exclusion) Combining District from 3,997 parcels outside the Coastal Zone. The notice says state housing officials directed the county to fix the conflict with state ADU law.

Hoodline reported that the change takes effect November 5, 2026, and that permits still review water, wastewater and fire safety; confirm the effective date and the parcel’s zoning with Permit Sonoma. Our post on land, building lots and ADUs in Sonoma County covers septic and well questions. Our Sonoma County vacation rental rules post covers the main house.

Cities in Napa and Marin set their own ADU and short-term rental rules within state law. Check the city for the address before counting on any particular use.

A sample monthly budget

This is a hypothetical, on our arithmetic, for an owner-occupied duplex in Sonoma County. Every figure is an assumption to replace with your lender’s quote, the parcel’s tax bill and a rent survey.

LineAssumptionMonthly
Purchase price$950,000
Down payment10%, or $95,000
Principal and interest$855,000 loan, 30 years, 6.5%$5,404
Property tax1.1% of price, before local charges$871
Insurance$3,000 a year$250
Repairs and reservesSet-aside for both units$200
Owner-paid utilitiesWater, sewer and garbage for both units$150
Total housing cost$6,875
Rent from the second unit$2,700, less 5% for vacancy−$2,565
Net cost to the ownerBefore mortgage insurance and income tax$4,310

The rent covers about 37% of the total in this example. Mortgage insurance, HOA dues and maintenance surprises would push the net up. Lenders may count only part of the projected rent when qualifying you, so don’t assume the full $2,700 helps you qualify. Our rental property analysis guide shows how to build the full worksheet.

Taxes when part of your home is a rental

IRS Publication 527 says that when a property has both personal and rental use, you must divide expenses between the two. Only the rental share is deductible as a rental expense, and land can’t be depreciated. If you later convert your own unit to a rental, its depreciation basis is the lesser of its adjusted basis or its fair market value at conversion.

The rules on personal use and below-market rent to relatives can limit deductions. Ask a tax adviser before renting to family, and keep separate records for the rental part from day one.

Before you write an offer

  1. Confirm the units are legal. Ask for permits and the certificate of occupancy for any second unit; our page on unpermitted ADUs explains the risk.
  2. Classify the property. One structure with two units, a house with an ADU, or a house with a JADU each lands under different rules.
  3. Check local ordinances. Some North Bay jurisdictions add just-cause or rental rules; see just cause eviction rules.
  4. Get a lender’s rent treatment in writing. Know how much of the second unit’s rent will count before you set a price.
  5. Read existing leases. Tenants in place stay, along with their deposits and protections.
  6. Plan the long term. Decide whether you’ll keep the property as a full rental when you move; our ADU investment guide covers adding units later.

Questions people ask

What is house hacking in real estate?

It’s buying a home you live in and renting part of it, such as another unit, an ADU or a room, so the rent offsets your mortgage and costs. It usually relies on owner-occupant financing, which allows smaller down payments than investment loans.

Can I use an FHA loan for house hacking?

Yes, if you’ll live in one of the units. FHA insures owner-occupied homes of one to four units. A 2017 HUD Inspector General memo summarizes the occupancy rule: move in within 60 days of signing the security instrument and live there for at least a year. Ask your lender how much rent it will count.

Is an owner-occupied duplex exempt from AB 1482?

Yes, from both the rent cap and the just-cause rule. That applies when the two units are in one structure, the owner lived in one at the start of the tenancy and still does, and neither unit is an ADU or JADU. Local rules may still apply.

Do I have to live on the property to rent out an ADU?

No. State law bars cities and counties from requiring owner occupancy for an ADU, though they may require rentals of 30 days or longer. A JADU is different: if it shares a bathroom with the house, the owner must live in the house or the JADU.

Can I rent my ADU on Airbnb in Sonoma County?

Not in unincorporated Sonoma County. Permit Sonoma’s ADU rules prohibit using an ADU as a vacation rental or for stays under 30 days. Cities set their own rules, so check the city for an in-town address.

What rules apply if I rent a room in my house?

If you rent to a single lodger and keep access to the whole home, Civil Code 1946.5 lets you end the arrangement with written notice. With more than one roommate, ordinary landlord-tenant law applies, though the just-cause rule doesn’t apply if the tenant shares a kitchen or bath with you.
