A “guest house” in a Napa, Sonoma or Marin listing can be a permitted accessory dwelling unit (ADU), a county-defined guest house or guest cottage with no kitchen, a pool house or studio approved as an accessory structure, or a conversion that was never permitted. Which one it is decides whether you can add a kitchen, rent it to a tenant or include it in a vacation rental. Before you count on any of those uses, match the building to its permit and to the county’s definition.

Search filters on listing sites pick up the words “guest house” from the listing remarks, not from permit records, so two homes in the same search can carry very different rights. This post covers how to search, how to read listing language, how to check permit status during escrow, and what each county allows for rentals. If you’re looking for several full homes on one parcel, our guide to family compounds in wine country and Marin covers dwelling counts, title and shared utilities.

What a listing might mean by “guest house”

State law defines ADUs and junior ADUs. Counties define guest houses, guest cottages and other accessory structures in their own zoning codes, and the definitions don’t match from one county to the next. The table below sets out the categories you’ll most often see in unincorporated Sonoma and Napa County, using each county’s published guidance.

What it is Kitchen Long-term rental Short-term or vacation rental What proves it
ADU (Sonoma County: up to 1,200 sq ft) Full kitchen required Yes No in unincorporated Sonoma County; ADUs approved under Government Code 66323 must be rented for more than 30 days Building permit and final inspection as an ADU
Junior ADU (Sonoma County: up to 500 sq ft, inside the house) Small kitchen Yes No in unincorporated Sonoma County Building permit and recorded deed restriction
Sonoma County guest house (up to 640 sq ft, detached) No kitchen or wet bar No; it can’t be rented or occupied separately from the main house Only as part of a vacation or hosted rental of the property, with a zoning permit Building permit for a guest house
Napa County guest cottage (up to 1,000 sq ft, and no larger than the main home) No kitchen; limited bar sink and small refrigerator only The county brochure describes use by the household’s family or nonpaying guests Check the county’s vacation rental rules Building permit and site plan approval
Pool house, studio or office Depends on the approval Only if permitted as a dwelling Only if the county allows it for that structure Building permit showing the approved use
Unpermitted conversion Often has one Not as a legal unit until permitted No Nothing yet; a legalization path and its cost

Permit Sonoma’s comparison chart is the source for the Sonoma rows. It notes that its accessory structure policy lists other types, such as studios and pool houses, so ask the county how a specific building was approved. Napa’s figures come from the county’s guest cottage brochure, dated January 2016, which says the County Code controls if the two conflict.

How to search for homes with a guest house

Treat the phrase as a starting filter, then widen it. Agents describe the same kind of building as an ADU, second unit, guest cottage, casita, in-law unit, pool house or studio, and a search on one term misses the others. Our property search lets you combine keywords with price, area and acreage filters.

  • Search several terms. Run “ADU,” “guest house,” “cottage,” “second unit” and “pool house” as separate keyword searches.
  • Read the remarks for permit language. “Permitted ADU” or “finaled” is a claim you can check. “Bonus room,” “flex space” or “not warranted” usually signals the building isn’t a permitted dwelling.
  • Look at the floor plan and photos together. A kitchen in a building listed as a guest house is the first question to ask about.
  • Look at estate areas. Larger lots are where detached guest quarters are most common; our guides to Sonoma luxury homes and pool homes in Sonoma wine country describe the estate stock.

Some owners sell without public marketing. Diamond reaches likely sellers through its own client database and targeted off-market campaigns, but it can’t offer access to other brokerages’ office-exclusive listings, and MLS rules such as NAR’s Clear Cooperation policy govern how listings are shared. Our page on private and off-market sales explains how that works.

How to check a guest house’s permit status during escrow

Do this inside your investigation contingency, before you remove it. A building’s legal status is far easier to resolve while you can still renegotiate or cancel.

  1. Ask the seller in writing. Request every permit, final inspection card and plan set for the building, and read the seller’s disclosures for anything said about work done without permits.
  2. Pull the permit history yourself. In unincorporated areas, ask Permit Sonoma, Napa County’s planning and building department or Marin County’s Community Development Agency. Inside a city or town, ask that city’s building department. Look for a final inspection, not just an issued permit.
  3. Match the approved use to the listing. A permit for a “guest house” or “accessory structure” isn’t a permit for a dwelling with a kitchen. Compare the permitted square footage with what you see.
  4. Read the preliminary title report. Junior ADUs carry a recorded deed restriction, and other approvals may come with recorded agreements that limit use.
  5. Test the septic system and well against the bedrooms you’ll use. State law lets an agency require a recent percolation test for an ADU on a septic system, and a system’s permitted capacity limits how many bedrooms the property can serve. Our guide to wells, septic and rural utilities lists what to order.
  6. Get insurance quotes that name the building. Tell each carrier what the structure is used for and how far it sits from the main house.

Converting a guest house, pool house or studio into an ADU

Many buyers plan to add a kitchen to a guest house. In Sonoma County that changes what the building is, because a guest house can’t have a kitchen or wet bar while an ADU must have a full kitchen. The conversion is a new permit under the ADU rules, not a remodel of the guest house.

State law makes this easier on residential lots. Government Code 66323 requires cities and counties to approve, without discretionary review, one ADU within the space of an existing house or an existing accessory structure, with up to 150 square feet of expansion limited to access. The county’s rules on size, septic and fire access still apply, and rural agricultural zones can add limits.

Permits run the other direction too: Napa’s brochure says converting an existing residence into a guest cottage needs a building permit.

For a unit that already has a kitchen but no permit, state law gives some room. Under Government Code 66331 and Health and Safety Code 17980.12, the owner of an ADU built before January 1, 2020 who receives a notice to correct violations can apply to delay enforcement of the building standard for five years. The agency must grant the delay if correcting the violation isn’t necessary to protect health and safety, after consulting the agency that enforces fire safety standards. Some newer ADUs, built while the local ADU ordinance didn’t comply with state law, also qualify.

Agencies can’t approve new requests on or after January 1, 2030. A delay isn’t a permit: the unit still isn’t legal, and it still belongs in the seller’s disclosures.

Can you rent a guest house in Sonoma, Napa or Marin?

It depends on what the building is and which jurisdiction it sits in. Start with the state rule: ADUs approved under Government Code 66323 must be rented for terms longer than 30 days.

Sonoma County

In unincorporated Sonoma County, ADUs and junior ADUs can be rented long term but not used as vacation rentals. A guest house can’t be rented or occupied separately from the main house, but Permit Sonoma says it may be used as part of a vacation rental or hosted rental with a zoning permit. Whole-home vacation rentals have their own permit, license and zoning limits, set out in our guide to Sonoma County vacation rental rules.

Napa County

Napa’s brochure defines guest cottage occupants as family members of the household or their nonpaying guests, which doesn’t contemplate paid stays. Rules for renting a whole home short term are stricter in Napa than in many places; see our post on Napa County vacation rental rules before you count on rental income.

Marin County

Unincorporated Marin licenses short-term rentals of less than 30 days and caps licenses at 1,200, not counting Dillon Beach. The county said in January 2024 that ADUs built in 2020 or later can’t be used as short-term rentals, and its February 2025 procedures exclude deed-restricted units and require a license for each unit on a property. Cities and towns in Marin set their own rules; our guide to Marin short-term rental rules has the details.

Price, insurance and lending effects

A permitted ADU is a second legal dwelling. An unpermitted conversion is a disclosure item with a cost to fix, and buyers, appraisers and lenders usually treat it that way. Price the two differently, and get the legalization estimate before you settle on a number.

Distance from the main house matters in fire country. The Department of Insurance’s Safer from Wildfires framework lists moving combustible outbuildings, including sheds and ADUs, at least 30 feet from the home as one of the mitigation steps that qualifies for an insurance discount. A guest house closer than that won’t block a policy on its own, but carriers will ask about it.

This is general information, not legal or tax advice; talk to a California real estate attorney or land-use consultant about your situation.

Questions people ask

What’s the difference between a guest house and an ADU in California?

An ADU is a full second dwelling defined by state law, with its own kitchen and bathroom. A guest house is defined by each county; in unincorporated Sonoma County it can’t have a kitchen or wet bar, is limited to 640 square feet and can’t be rented separately from the main house.

Can a guest house have a kitchen?

Not in unincorporated Sonoma County, where a kitchen or wet bar isn’t allowed. Napa County’s guest cottage brochure prohibits a kitchen but allows a small bar sink and a refrigerator of 6 cubic feet or less. A building with a full kitchen needs to be permitted as an ADU or another dwelling.

Can I rent out a guest house in Sonoma County?

Not on its own. A Sonoma County guest house can’t be rented or occupied separately from the main house, though it may be used as part of a vacation or hosted rental of the property with a zoning permit. An ADU can be rented long term but not as a vacation rental.

How do I find out whether a guest house is permitted?

Ask the seller for permits and final inspections, then confirm with the county or city building department that issued them. Check that the approved use and square footage match the building you’re buying.

Can I turn a pool house into a guest house or ADU?

Often, with a building permit. State law requires cities and counties to approve one ADU within an existing accessory structure on a residential lot, subject to building codes and local standards. Septic capacity, fire access and agricultural zoning can still limit what’s possible.

Can I use an ADU as an Airbnb?

Usually not. ADUs approved under Government Code 66323 must be rented for more than 30 days, Sonoma County bars ADUs from vacation rental use, and Marin County says ADUs built in 2020 or later can’t be short-term rentals.

Should I walk away from a home with an unpermitted guest house?

Not necessarily. Price it as non-permitted space, get a legalization estimate during your contingency period, and confirm your lender and insurer will accept it. Owners of ADUs built before 2020 who get a notice to correct can apply for a five-year delay of enforcement if the problems aren’t health and safety issues, but a delay doesn’t make the unit permitted.
