What multifamily in Mount Hamilton looks like

Multifamily on Mount Hamilton is mostly a question of what the County will let you add to a large rural parcel. There are no apartment buildings for sale on the mountain. The summit is home to the University of California’s Lick Observatory, at about 4,200 feet, and the private land below it is ranches and scattered hillside homes. A rental investment here usually means a main house with an ADU or JADU, a ranch with permitted farmworker housing, or a legal nonconforming second home on a large lot. For small-property lending, see financing 2-4 unit properties. Apartment building loans are relevant only for purchases elsewhere in the county.

Where the zoning allows it

Mountain parcels are usually in the County’s Hillside (HS) or Agricultural Ranchlands (AR) districts under Chapter 2.20; confirm each parcel on the County zoning map.

Housing type HS Hillside AR Ranchlands Notes
Single-family home By right By right One per qualifying lot
ADU and JADU By right By right No rentals under 30 days
Movable tiny home Planning clearance Planning clearance
Small permanent farmworker housing Special permit Special permit Planning clearance in A and RR
Large or seasonal farmworker housing Special permit Special permit
Temporary agricultural residence Planning clearance Planning clearance Capped at 50 countywide
Duplexes, apartments Not allowed Not allowed Only on -os housing opportunity sites

Lot size and density. Both districts start from a 160-acre base lot. The slope-density formula then sets how much land each home needs, from 20 acres on land under 10% slope to 160 acres at 50% or steeper. Hillside lots under 160 acres need a cluster permit, with development held to 10% of the land and at least 90% kept as open space. Ranchlands has its own caps on new lots. In short, adding a second primary home to most Mount Hamilton land means owning a very large parcel.

SB 9. The County’s SB 9 tool, the Urban Primary Unit, is allowed only in Rural Residential among the rural districts. In a June 24, 2025 letter, the state housing department told the County that the A, AR and HS zones should be included and that septic and water standards for SB 9 must be objective. Until the County amends its rules, treat SB 9 on Mount Hamilton land as unsettled. See our SB 9 lot split guide and ADU investment guide.

Rent rules: state law and County protections

The Attorney General’s rent cap page, updated July 16, 2026, lists no local rent ordinance for unincorporated Santa Clara County. Covered units follow AB 1482, at up to 8.6% for increases from August 1, 2026 through July 31, 2027. A single-family home owned by an individual can be exempt with the proper notice, which covers many rural rentals. See our AB 1482 guide.

Unsafe-condition relocation. County Code Division C5 requires an owner to provide substitute housing or three months of HUD fair market rent plus utilities when a tenant must leave over unsafe or hazardous conditions. That matters on rural property if a cabin or converted outbuilding is rented without permits. An eviction served within six months after the owner learns of a pending violation is presumed to be condition-based.

Expanded tenant ordinance. Local press reported in June 2026 that the Board of Supervisors approved broader tenant protections for unincorporated areas; we did not find the adopted text on a County site, so confirm terms and timing. See our just cause eviction guide.

Mount Hamilton rental property rules

  • No nightly ADUs. County rules bar ADU rentals of less than 30 days, so ADUs are long-term rentals only.
  • Farmworker housing. Housing for agricultural employees is possible by special permit, but it must serve the farm operation, not general renters.
  • Scenic road. Along Mt. Hamilton Road, from Springview Lane to San Antonio Valley Road, any new structure within 100 feet of the right-of-way needs design review under the County’s -sr district.
  • Transfer tax. Only the County’s $0.55 per $500 applies.

Wells, septic, roads and fire

The County describes Hillside zoning as limiting development so it will not need public services. In practice, each unit on Mount Hamilton depends on its own well, septic system and access road. HCD’s 2025 letter found the County’s water availability and septic standards for SB 9 too subjective, which shows how central those systems are to approval. Before buying for an added unit, get a well yield test, a septic feasibility review and a read on road and fire access, and check fire hazard zoning and insurance. Older ranch houses and outbuildings should get a structural and seismic retrofit review. SB 721 balcony inspections apply only at three or more units.

Underwriting a Mount Hamilton rental purchase

  1. Confirm the zoning, parcel size and average slope, then run the slope-density math before assuming any added home.
  2. Verify that every existing dwelling is permitted; unpermitted units carry Division C5 relocation risk.
  3. Price well, septic, road and fire work into any ADU plan.
  4. Classify each tenancy under AB 1482 and model long-term rents only.
  5. Collect leases and estoppel certificates.
  6. Rebuild expenses, including rural insurance, in our rental property analysis.

Mount Hamilton access and operating logistics

Lick Observatory’s visitor guidance describes a narrow, sharply curving road, no fuel or automotive services outside San Jose along the route, and possible winter snow closures. It directs drivers to check Highway 130 conditions. These are practical constraints for deliveries, contractors and occupants of nearby private properties. Review the actual access route, vehicle requirements and contingency arrangements when budgeting an operation or rental. Observatory visitor access does not establish a right to use UC facilities or private roads.
