Commercial Real Estate in Fulton: County Zoning, Rural Commercial Uses and Service Limits

By Matthew Martinez, Founder, CEO & Managing Broker, Diamond Real Estate Group. California DRE #01869679.

Fulton is a small unincorporated community just northwest of Santa Rosa, around River Road and Fulton Road near Highway 101, where older roadside businesses, contractor and service yards, wineries and farm parcels sit between Santa Rosa’s edge and the vineyards toward the Russian River. Fulton is not part of Santa Rosa, so the County of Sonoma and Permit Sonoma decide land use. Confirm the zoning of any parcel in the County’s Official Zoning Database before relying on this page.

Who controls the parcel

  • County land use. Permit Sonoma applies Chapter 26 of the County Code. The City of Santa Rosa’s zoning, taxes and transfer tax do not apply to Fulton parcels unless they are annexed.
  • Service boundaries. A central-point map query cannot establish utility availability for the whole community. Check the actual parcel, service boundary and connection records. Water service must be checked by address. California American Water’s 2024 Larkfield water-quality report expressly lists Fulton among the communities served. The system uses Glen Ellen formation wells and purchased Sonoma County Water Agency water, supplies residential and commercial customers, and treats naturally occurring arsenic, iron and manganese as well as disinfecting the supply. This identifies a public water provider in the community; it does not establish a connection, capacity or fire flow for every parcel. Obtain the seller’s bill and written provider confirmation. Wastewater service is a separate inquiry: confirm an actual sewer connection or obtain septic permits and capacity records.
  • Roads. Confirm whether the road frontage is maintained by the County or the City of Santa Rosa, and whether any work touches Caltrans right of way near Highway 101, before planning a new driveway.

Fulton zoning for commercial, industrial and mixed use

The menu comes from County Article 10, Article 12 and Article 06. Which districts are actually mapped in Fulton has to be read from the zoning database.

District Intended uses Notes
CR Commercial Rural Homes and commercial together in rural areas and unincorporated communities County keeps discretionary review of new commercial; tasting rooms P*; banks and bars by use permit
AS Agricultural Services Uses supporting local agriculture Tasting rooms and ag support services P*; farm stands permitted; hotels by use permit
C1 / LC Neighborhood or limited commercial Restaurants P/C; mixed use allowed
C3 General Commercial Wholesale, warehousing, light and medium manufacturing Vehicle sales permitted
M3 Limited Rural Industrial / MP Industrial Park Rural industry; planned industrial Article 12 standards apply; not reviewed in detail
LIA, DA, RR, AR Farmland and rural residential Tasting rooms and processing by use permit on farmland; no agricultural service uses in RR

Every County commercial district has a 35-foot height limit in Table 10-2. Under Section 26-10-040, a use permit can allow more height only within the building-intensity limit.

What business uses fit Fulton

Rural commercial. The CR district’s stated purpose is to mix homes and commercial uses in rural areas while the County keeps discretionary review over new commercial uses. Expect new or expanded businesses to go through a use permit or design review, not a counter permit.

Agricultural services and wine. AS is limited to uses that support local agriculture, and tasting rooms there are P*. On farmland, the County’s Table 6-1 treats uses this way:

  • Tasting rooms and agricultural processing need a use permit.
  • Small-scale processing and periodic special events are P*.
  • Farm stands and farm retail are permitted.
  • In RR, the County says agricultural service uses are not allowed at all.

See our guides to winery use permits and tasting room space.

Contractor and service yards. Contractor storage yards are conditional in LC, and C3 permits warehousing and light manufacturing. A yard already operating on farmland or rural residential land may be legal nonconforming, or unpermitted. Ask Permit Sonoma for the permit history before buying.

Lodging, vacation rentals and flood

  • Vacation rentals. Permit Sonoma bars them in R1 to R3, LIA and on Williamson Act land. The County’s 2023 cap and exclusion staff report proposed no zone for Fulton. See our vacation rental rules.
  • Hotels. Hotels are not listed in CR and need a use permit in AS, C2 or K.
  • Flood. Parcels near creeks may be mapped in FEMA floodplain. Under Chapter 7B, commercial buildings there must be elevated or floodproofed 12 inches above base flood elevation. Work reaching 50% of value over three years triggers full compliance. Low ground draining to the Laguna de Santa Rosa may also face the zero-net-fill rule in Section 26-58-030(d).

Transfer tax, business tax and property tax

The Sonoma County Recorder charges $0.55 per $500, less loans assumed. Santa Rosa’s additional $2.00 per $1,000 applies only to property inside Santa Rosa, so a Fulton parcel pays the County rate alone. A change of ownership generally triggers Proposition 13 reassessment. We did not verify County business tax rules.

Due diligence that matters in Fulton

Start with our commercial due diligence checklist, then:

  • Confirm the parcel is unincorporated and not annexed into Santa Rosa.
  • Pull the base zone, suffixes and the full permit history for every business use on site.
  • Confirm well yield and water quality, or the water provider, plus septic design and capacity.
  • Check FEMA mapping and County flood rules.
  • For wine or event uses, read the use permit conditions.
  • Confirm road access and any Caltrans encroachment needs near Highway 101.

Questions people ask

Is Fulton part of Santa Rosa?

No. Fulton is unincorporated, so Permit Sonoma, not the City of Santa Rosa, handles zoning.

How do I establish utility service for a Fulton parcel?

A community label or a single map point is insufficient. Obtain a current bill, provider service confirmation and sewer or septic records for the exact address.

What transfer tax applies in Fulton?

Only the County’s $0.55 per $500; Santa Rosa’s city tax applies only inside the city.

Can I open a tasting room in Fulton?

In CR or AS zoning, tasting rooms are P*. On farmland, they need a use permit.

Can I run a contractor’s yard?

Contractor storage yards need a use permit in LC; C3 and industrial districts allow more intensive service uses. Check the parcel’s permit history.

Are there vacation rental caps in Fulton?

No Fulton cap was proposed in 2023, but County rules still bar them in R1 to R3 and on LIA and Williamson Act land.

Fire protection and site review

The Sonoma County Fire District names Fulton in its service area. Ask the district about emergency access and the water supply required for the proposed occupancy before assuming a site can support more residents, employees or visitors. A district service boundary does not establish that a particular driveway or building meets current requirements.
