What multifamily in Saratoga looks like
Multifamily is scarce in Saratoga. Most of the city is single-family and hillside land, and the existing income property is a small inventory of apartment and condominium buildings in the R-M districts, units over shops in and near the Village, and single-family homes with accessory dwelling units. What changed recently is capacity: the city created mixed-use districts in 2024, with densities far above anything previously allowed, and adopted a new inclusionary ordinance in 2025. For two to four units, read financing 2-4 unit properties; for larger buildings, see apartment building loans.
Where the zoning allows it
| District | What is allowed | Density | Key standards |
|---|---|---|---|
| R-M-3,000 | Multifamily permitted; hotels by use permit | One unit per 3,000 sq ft of net site | 12,000 sq ft minimum interior site; 40% coverage; 30 ft, 2 stories |
| R-M-4,000 | Multifamily permitted | One unit per 4,000 sq ft | 12,000 sq ft minimum interior site |
| R-M-5,000 | Multifamily permitted | One unit per 5,000 sq ft | 10,000 sq ft minimum interior site |
| C-N, C-V, CH-1, CH-2 | Mixed-use housing by conditional use permit | Up to 20 units/acre | 35 ft and 3 stories with housing |
| MU-MD | Residential or mixed use, at least 50% housing | 15 minimum; 15 to 25 maximum by site size | 35 ft, 3 stories |
| MU-HD | Residential or mixed use | 30 minimum; 30 to 40 maximum | 35 ft, 3 stories |
| MU-VHD | Residential or mixed use | 80 minimum; 80 to 150 maximum | 125 ft, 12 stories |
R-M details. The R-M code counts units by net site area, and if the leftover area is at least 90% of what another unit needs, one extra unit may be allowed. Structures cannot sit on slopes over 40%, and the two-story limit can be relaxed in the Village if the building is found compatible. The R-M text lists multifamily dwellings but not duplexes by name, so confirm a two-unit plan with Planning.
Mixed-use tiers. In the M-U districts, maximum density rises at half an acre and again at three-quarters of an acre, so assembling a larger site can raise capacity sharply. Minimum densities also apply.
Inclusionary housing. Article 15-82, adopted by Ordinance 408 on April 2, 2025 and applied to applications from May 2, 2025, covers projects of five or more units, counting ADUs. Rental projects must make at least 15% of units affordable to lower-income households, half of those at very low income; ownership projects must make 15% affordable at moderate income. Off-site alternatives need City Council approval.
ADUs and SB 9. ADUs follow Article 15-56, and SB 9 two-unit projects and lot splits can apply on qualifying single-family lots under state law; confirm the city’s standards. See our ADU investment guide and SB 9 lot split guide.
Rent rules: state law only
The Attorney General’s rent cap page, updated July 16, 2026, places Santa Clara County in All Other Counties, with covered units allowed up to 8.6% for increases from August 1, 2026 through July 31, 2027. Its chart lists only San Jose and Mountain View in this county as having local rent stabilization, so Saratoga rentals follow AB 1482’s cap and just-cause rules for covered units, with exemptions for buildings under 15 years old and qualifying individually owned homes. See our AB 1482 guide and just cause eviction guide.
Saratoga rental property rules
- No short-term rentals. Article 15-42, as rewritten by Ordinance 416 on February 4, 2026, bars renting any residential dwelling or part of one for 30 consecutive days or less, paid or by swap. Advertising is also barred, each day an ad runs is a separate offense, and fines run up to $1,500, $3,000 and $5,000 for repeat violations within a year.
- Platform reporting. Under the state’s 2025 facilitator law as applied in Saratoga, booking platforms must report rental addresses to the city on request.
- Taxes. Paying business license fees or transient occupancy tax does not legalize a prohibited rental.
- Transfer tax. The County’s documentary transfer tax is $0.55 per $500, and Saratoga’s Article 5-15 sets 27.5 cents per $500, administered by the County Recorder and generally credited within the County rate.
Hillsides, older buildings and utilities
Saratoga’s R-M buildings are mostly low-rise wood frame from past decades; review them for seismic retrofit needs, and buildings of three or more units with elevated balconies or walkways need SB 721 balcony inspections. The R-M slope limits (30% average grade under a structure, nothing on slopes over 40%) can cap expansion on sloping sites.
