What multifamily in San Pablo looks like

San Pablo’s rental stock is mostly older and small-scale:

  • Duplexes and small lots with two homes in the R-2 neighborhoods
  • 1950s to 1970s walk-up apartment buildings near San Pablo Avenue and 23rd Street
  • Older multifamily kept in place by the MF overlay where base zoning changed
  • New mixed-use and affordable projects on the corridors
  • Single-family homes with ADUs

Since 2023 the city has added a rent registry, and in 2026 local just cause and anti-harassment ordinances. Its long-running inspection program also applies at every sale. See financing 2-4 unit properties and apartment building loans.

Where the zoning allows it

Residential districts are in Chapter 17.32, with standards last amended by Ordinance 2025-004 in December 2025.

District Max density Height Duplex Multifamily
R-1 Single-Family 12 units/acre 20 ft eave, 27 ft peak, 2 stories No No
R-2 Two-Family 18 units/acre 20 ft eave, 27 ft peak, 2 stories Yes No
R-3 Multifamily 24 units/acre 40 ft eave, 48 ft peak Yes Yes
R-4 High-Density Multifamily 48 units/acre 60 ft eave, 75 ft peak No Yes
RMU Residential Mixed-Use 50 units/acre, FAR 1.5 Up to 60 ft No Yes
PD Planned Development 60 units/acre 60 ft eave, 75 ft peak No Yes
CMU, MUCW, EMU, CR 50 to 60 units/acre 50 to 60 ft Varies Yes

Within 75 feet of R-1 or R-2, taller districts drop to 40 feet at the eave and four stories. Densities can rise under the state and city density bonus laws.

Overlays. The MF overlay keeps existing apartment buildings legal where the base zone no longer allows multifamily. They can be rebuilt or expanded to R-3 or R-4 standards. The D2 transit overlay on Rumrill, 23rd Street and San Pablo Avenue allows 20 to 60 units per acre. Within 500 feet of I-80, the D3 overlay requires a use permit and MERV 16 ventilation for new housing.

ADUs and SB 9. ADUs are permitted by right in every residential district, and JADUs in single-family homes. Standards are in Section 17.60.070, which we did not review. Chapter 17.32 does not mention SB 9, but state law applies to qualifying R-1 lots. See our ADU investment guide and SB 9 lot split guide.

Rent rules: state cap plus local just cause

San Pablo has no local rent cap. It does not appear on the Attorney General’s rent cap chart. Covered units follow AB 1482: 6.3% for August 1, 2025 through July 31, 2026, and 8.8% for August 1, 2026 through July 31, 2027. The city’s rental regulations mailer notes a 2024 rent control initiative did not qualify for the ballot.

Just cause, Chapter 9.70. Adopted by Ordinance 2026-001 on March 2, 2026, it reaches further than state law:

  • Coverage. Condos, duplexes, ADUs and JADUs are covered even where state law would exempt them. Single-family homes are exempt unless owned by a REIT, corporation or LLC with a corporate member. Mobile home spaces are exempt.
  • No-fault relocation. The landlord picks one of three options: two months’ rent, a waiver of the last two months’ rent, or one month of each. The choice must be stated in the notice.
  • Substantial remodel. All permits must be in hand before the notice, and copies, scope and timeline go with it. Tenants get a one-year right of first refusal.
  • Owner move-in. If the owner does not move in within 90 days or stay 12 months, the tenant has a right to return.
  • Remedies. Noncompliance is a defense to eviction. Willful violations can bring treble and punitive damages.

Anti-harassment, Chapter 9.80. Adopted by the same ordinance, Chapter 9.80 bars conduct meant to push tenants out. Examples include refusing repairs, excessive entry, threats about immigration status, lockouts and repeat buyout offers within six months of a refusal. Retaliation is barred.

Tenant relocation rules also appear in Chapter 8.05, and the more protective rule controls. See our AB 1482 guide and just cause eviction guide.

San Pablo rental property rules

Rent registry. A May 2023 ordinance requires every covered rental unit to be registered each year, including tenancy changes. The mailer lists no fee.

Residential Health and Safety program. Under Chapter 15.52, non-owner-occupied units over three years old need a rental certificate. Its length depends on inspection results: five years for a clean unit, down to one year for a poor one. Renting without a certificate is a public nuisance. Tenants can request an inspection at no cost to the owner after reporting a problem in writing.

At sale. The seller must apply for a resale certificate and fix health and safety violations. If work remains, the buyer can sign and record a temporary certificate and must finish within 60 days of closing. A rental certificate is generally not needed for 12 months after a sale with a valid resale or temporary certificate.

Older buildings and the I-80 corridor

Much of San Pablo’s apartment stock is wood-frame from before 1980. Get a seismic retrofit review for buildings over open parking. We did not find a mandatory soft-story program. Buildings with three or more units and elevated balconies need SB 721 inspections. Creekside properties may be in the CP overlay, which bars structures in floodways.

San Pablo’s Chapter 3.20 sets a city transfer tax of $0.275 per $500. The Recorder lists only the $0.55 per $500 county rate for San Pablo, so confirm the total with escrow.

Underwriting a San Pablo multifamily purchase

  1. Confirm the district, any MF or D3 overlay, and the unit count allowed.
  2. Get the resale certificate inspection scheduled early and price required repairs.
  3. Ask for annual rent registry filings and the current rental certificate.
  4. Check every termination or remodel notice against Chapters 9.70 and 9.80, and budget relocation for any planned no-fault move-out.
  5. Collect leases and estoppel certificates, and model increases under AB 1482.
  6. Add reassessed property tax, inspection repairs and SB 721 work to your rental property analysis.
