What multifamily in Oakville looks like
Oakville is not an apartment market. Napa County’s General Plan put its population at about 300 in 2006 and describes it as a small commercial and residential center on Highway 29, left off the Land Use Map so that little new development occurs. Income property here means a vineyard estate with an ADU, JADU or guest cottage, farmworker housing on agricultural land, or an apartment within a legacy commercial building. Anyone seeking larger buildings should look to Yountville, St. Helena or the City of Napa. For financing small properties, see financing 2-4 unit properties; for larger buildings elsewhere, see apartment building loans.
Where the zoning allows it
Unincorporated Oakville is under Napa County Title 18 and the County’s Agricultural Preservation and Land Use Element.
| District or rule | Housing allowed | Key limits |
|---|---|---|
| AP Agricultural Preserve | One single-family home per legal lot, ADUs and one JADU | General Plan minimum parcel for Agricultural Resource land is 40 acres |
| AP farmworker housing | Housing for six or fewer employees, or up to 36 group beds or 12 units, without a use permit | Subject to Sections 18.104.300–.310; larger projects by use permit |
| AW Agricultural Watershed | One home, ADUs, JADU, guest cottage, small farmworker housing | General Plan minimum parcel for AWOS land is 160 acres |
| Commercial parcels zoned as of February 1, 1990 | Mixed residential-commercial uses the zoning permits (Policy AG/LU-45) | Developed under existing zoning (Policy AG/LU-97) |
| CL or CN commercial | A commercial ADU by use permit | Deed-restricted to moderate-income or lower households |
Parcel sizes. The General Plan element sets 40-acre minimum parcels for Agricultural Resource land (Policy AG/LU-21) and 160 acres for Agriculture, Watershed and Open Space (Policy AG/LU-20). Both allow 2-acre parcels for farm labor camps under set conditions. Splitting an Oakville vineyard to add homes is generally not an option.
Voter protection. The element says Measure J (1990) requires a public vote to convert agricultural land, and Measure P, adopted by voters in 2008, locks those policies in until after December 31, 2058 unless voters agree otherwise. Rezoning vineyard land for apartments would require an election.
ADUs. The AP chapter, last amended by Ordinance 1495 on September 24, 2024, allows ADUs and a JADU if Section 18.104.180 is met. The County’s ADU page allows ADUs up to 1,200 square feet and JADUs up to 500. It cautions that inadequate water, groundwater overuse or a failing septic system can stop a permit. See our ADU investment guide.
SB 9. SB 9 applies only to single-family lots in urbanized areas or urban clusters, and Oakville’s agricultural parcels are unlikely to qualify. Confirm with the County. See our SB 9 lot split guide.
Rent rules: state law only
Rent caps. The Attorney General’s rent cap page, updated July 16, 2026, places Napa County in All Other Counties. Covered units may rise up to 7.7% for increases from August 1, 2025, and 8.6% from August 1, 2026 through July 31, 2027. No Napa County jurisdiction appears on the AG’s chart of local rent ordinances. Many Oakville rentals are single-family homes or ADUs, which may be exempt from AB 1482 if the owner gives the required notice; confirm each unit. See our AB 1482 guide and just cause eviction guide.
Employer housing. Farmworker housing tied to employment follows the state Employee Housing Act and the County’s conditions, not ordinary landlord economics. Read any recorded restrictions.
Oakville rental property rules
- No vacation rentals. County Code Section 18.104.410 bars transient commercial occupancy of dwellings in every residential and agricultural district. A vineyard cottage cannot be rented by the night.
- ADU covenant. Before an ADU permit issues, the owner records a covenant that neither the ADU nor the main home will be rented for under 30 days.
- Lodging is commercial. Short-stay lodging belongs in a permitted inn or B&B in a commercial district such as CL, which allows up to 50 rooms by use permit.
- Transfer tax. The County’s document transfer tax is $0.55 per $500, customarily paid by the seller; there is no city tax.
Wells, septic and the valley floor
Outside the cities, wells and septic systems set how many units a parcel can carry, and the County lists water and septic problems among reasons to deny an ADU. Wineries and vineyards in Oakville also draw on the same groundwater, so test the well yield and inspect the septic system before counting a second unit as income. The Oakville AVA boundary follows the Napa River in part, so check flood exposure on low-lying parcels. Older farmhouses and outbuildings converted to living space should be checked for permits and for seismic retrofit needs. Any building of three or more units with elevated decks needs SB 721 balcony inspections.
Wine-country context. The federal Oakville AVA (27 CFR 9.134, effective August 2, 1993) covers the valley floor and benchlands between Yountville and Rutherford. Vineyard value, not rent, usually drives what these properties sell for, so underwrite rental income as secondary.
Underwriting an Oakville income property
- Confirm the zoning, General Plan designation and legal lot status.
- Count only permitted units, and pull permits for every ADU, cottage or farmworker unit.
- Test the well and septic, and confirm capacity for any added unit.
- Underwrite long-term rents only; nightly rentals are barred.
- Classify units under AB 1482, model covered increases at or below 8.6%, and collect estoppel certificates.
- Rebuild expenses with reassessed taxes, insurance and vineyard operating costs in our rental property analysis.
Questions people ask
Can I build apartments in Oakville?
Practically no. Oakville is off the Land Use Map, its land is agricultural, and converting it generally needs a public vote.
How many homes can an Oakville vineyard parcel have?
One single-family home per legal lot in AP, plus ADUs, a JADU and limited farmworker housing.
Can I rent a guest cottage nightly?
No. The County bars transient occupancy of dwellings, and ADUs carry a 30-day covenant.
Is there rent control in Oakville?
No local ordinance applies. Covered units follow AB 1482.
Can a commercial building include an apartment?
On parcels zoned commercial as of February 1, 1990, mixed residential-commercial uses permitted by the zoning may be allowed under Policy AG/LU-45.
What limits ADUs most here?
Water and septic. The County may deny an ADU for inadequate potable water or a failing septic system.
