What multifamily in Nicasio looks like

Nicasio has no apartment buildings in the usual sense. The FIRESafe Marin summary counts about 1,000 residents in roughly 450 homes spread over 22,500 acres of ranch and wildland. Rental housing here mostly means a ranch house plus an ADU or JADU, agricultural worker housing, guest units, and the occasional older property with several cottages. For a buyer, the questions are how many legal units a parcel can hold and whether its water and septic can serve them. For financing, see financing 2-4 unit properties and apartment building loans.

Where the zoning allows it

Nicasio is unincorporated and inland, so Marin County’s Title 22 applies. County project files show ARP-20 zoning on Indian Hill Road, meaning one unit per 20 acres, and APZ-10 on Lucas Valley Road. Housing types follow Chapter 22.08 and Chapter 22.10.

District Housing allowed Notes
ARP (e.g. ARP-20) Single-family homes, ADUs, JADUs, agricultural worker housing Density per the zoning map suffix. Homes clustered on about 5% of the parcel
APZ (e.g. APZ-10) Farm homes and agricultural worker housing Planned district with design review. APZ use table not reviewed
A2 to A60 Single-family homes, ADUs, JADUs, agricultural worker housing Minimum lot set by the number, in acres
R2 / RMP (only where mapped) Two-family and multifamily permitted We found no record of these districts in Nicasio

ADUs. ADUs and JADUs are permitted in the agricultural districts under Sections 22.32.120 and 22.32.125. On a ranch, a new ADU often adds more rental income than anything else. Sizing the well and septic is usually the hard part. See our ADU investment guide.

SB 9. SB 9 applies only to parcels in single-family residential zones. Agricultural districts such as ARP, APZ and A generally fall outside it, so most Nicasio parcels are not candidates. See our SB 9 lot split guide.

Agricultural worker housing. This housing is permitted in the agricultural districts. Units under a recorded agricultural worker restriction cannot be rented to the general public or used as short-term rentals.

Rent rules: state law plus Marin County’s just cause and mediation

Rent caps. No local cap applies. AB 1482 covers qualifying units, and the Attorney General’s chart sets the San Francisco Area maximum at 8.8% from August 1, 2026 through July 31, 2027. See our AB 1482 guide.

County just cause. The county’s just cause ordinance, Chapter 5.100 (Ordinance 3705, December 2018), applies in unincorporated areas like Nicasio. It covers lots with three or more dwelling units. Permitted ADUs and JADUs do not count toward the three, but unpermitted units do. A ranch with a main house, a permitted ADU and one older cottage may fall below the threshold, while one with two unpermitted cabins may be covered. Before ending a tenancy, a landlord needs a county rental business license, a tenant-rights notice and registration in the county Rental Registry. A copy of the termination notice must go to the county within 10 days. See our just cause eviction guide.

Mediation. Under Chapter 5.95, adopted in September 2018, the county’s mandatory mediation program lets tenants request free mediation of increases above 5% in 12 months. A landlord who does not take part in good faith risks having the increase invalidated.

Nicasio rental property rules

  • Short-term rentals. Under Chapter 5.41, the Nicasio township is capped at 11 licenses initially and 8 over time. ADUs created after 2020 or 2021, multifamily units and agricultural worker units are ineligible. Agricultural homestays, B&Bs and units on agricultural parcels of ten acres or more in commercial agriculture are exempt from the program.
  • Business license. Rental units need a county business license, billed per unit.
  • Multi-unit inspections. The county’s Environmental Health program inspects rental properties with three or more units outside San Rafael and Novato. Ask whether an annual permit applies.
  • Design review. New units in planned districts go through county design review and comment from the Nicasio Design Review Board, using the 1997 Nicasio Valley guidelines.

Water, septic and wildfire

Most Nicasio homes rely on wells, springs or small water systems, with septic for wastewater. Small systems face state rules. The Nicasio School, for example, added filtration in 2024 to comply with surface water treatment requirements. Before adding a unit, expect county Environmental Health to want proof of adequate water and a septic design sized for the added bedrooms. Wildfire exposure is high across the wildland interface, and some roads are private. Older cottages and converted ranch buildings may need a seismic retrofit review. Any building with three or more units and elevated decks needs SB 721 inspections.

Underwriting a Nicasio multifamily purchase

  1. Confirm zoning, any master plan building envelope and the permit status of every dwelling.
  2. Count units the way the county does to see whether the just cause rule applies.
  3. Test well yield and water quality, and get septic records and capacity.
  4. Model rent increases at or below 8.8%, and plan for mediation on anything over 5%.
  5. Collect leases, the rent roll and estoppel certificates, and identify any agricultural worker restrictions.
  6. Rebuild expenses with reassessed taxes, insurance in a high fire area, the county license and water treatment in our rental property analysis.

Questions people ask

Can I buy a duplex in Nicasio?

Duplex zoning is rare to absent. Most parcels are agricultural, where housing beyond the main home takes the form of ADUs, JADUs and agricultural worker units.

Does Marin County’s just cause rule apply?

Yes, on lots with three or more dwelling units, not counting permitted ADUs and JADUs.

Does SB 9 apply in Nicasio?

Generally not. SB 9 applies in single-family residential zones, and most Nicasio parcels are zoned agricultural.

Can I rent an ADU short-term?

Only if it qualifies under the county STR rules and fits under the Nicasio cap. ADUs created after 2020 or 2021 are ineligible.

Is there a city transfer tax?

No. Only the county’s $0.55 per $500 applies, per the Recorder.

What usually limits adding units?

Water and septic capacity, then design review and fire access.
