What multifamily in Menlo Park looks like
Menlo Park’s rental stock ranges from duplexes and small garden apartments in its R-2 and R-3 neighborhoods to newer mid-rise buildings on El Camino Real and large mixed-use projects on the Bayfront near Belle Haven. For two to four units, read financing 2-4 unit properties; for five or more, see apartment building loans. Note that five units is also where Menlo Park’s relocation assistance law begins to apply.
Where the zoning allows it
Title 16’s district list includes seven residential districts that allow two or more units, plus mixed-use options. The standards below come from the city’s December 2018 zoning summary sheet and the R-MU chapter; confirm current figures in the code.
| District | Use | Key standards (2018 sheet unless noted) |
|---|---|---|
| R-2 Low Density Apartment (16.18) | Duplexes and small apartments | 7,000 sq ft lots; one unit per 3,500 sq ft; 28 ft |
| R-3 Apartment (16.20) | Apartments | 7,000 sq ft lots; 35 ft. Lots of 10,000 sq ft near the specific plan area range from 3,333 down to 1,452 sq ft per unit, with up to 40 ft at 20+ units an acre |
| R-3-A Garden Apartment (16.24) | Garden apartments | 10,000 sq ft lots; FAR 45%; no fixed height, larger setbacks above 35 ft |
| R-3-C Apartment-Office (16.26) | Apartments or offices | Follows R-3 for housing |
| R-4 High Density (16.22) | Apartments | 20,000 sq ft to 1 acre; 40 units an acre; FAR 100%; 40 ft |
| R-4-S and R-4-S(AHO) (16.23) | Housing Element sites | 20,000 sq ft; 20 to 30 units an acre; FAR 60–90%; 40 ft |
| R-MU Residential Mixed Use (16.45) | Bayfront housing with retail | Code: 20–30 units an acre base, up to 100 at bonus; 40 ft max base, 70 ft bonus |
| SP-ECR/D (16.58) | Downtown and El Camino Real mixed use | Standards in the specific plan |
Bayfront housing. R-MU requires multiple dwellings in every project. Bonus-level density depends on community amenities valued at half the appraised value of the bonus area. Affordable units must be built on site, with a preference for current or recently displaced Belle Haven residents.
Downtown capacity. The specific plan’s 2014 implementation chapter capped net new housing at 680 units in that edition. The plan has been amended since, most recently in 2024, so check the current cap and remaining capacity.
ADUs and SB 9. ADU rules are in Chapter 16.79. State law sets the floor for ADUs on single-family and multifamily lots, and SB 9 applies to qualifying single-family lots. We did not review the city’s ADU chapter. See our ADU investment guide and SB 9 lot split guide.
Inclusionary housing. Under the BMR chapter, projects of five or more units must make at least 10% of units below market rate. At 20 or more units the share rises to 15%. Condominium conversions are covered too. Rental projects may propose in-lieu fees, land dedication, off-site units or acquisition and rehabilitation, with Council approval.
Rent rules: state law, plus local relocation assistance
Rent caps. The Attorney General’s rent cap page, updated July 16, 2026, puts San Mateo County in the San Francisco area: covered units may rise up to 8.8% for increases from August 1, 2026 through July 31, 2027. Menlo Park does not appear on the AG’s list of cities with local apartment rent ordinances. See our AB 1482 guide and just cause eviction guide.
Relocation assistance. Menlo Park’s Chapter 8.56, adopted by Ordinance 1053 in 2019, requires relocation assistance when a landlord displaces tenants. It applies when the landlord does any of the following:
- withdraws the units from the rental market
- demolishes or removes units
- remodels in a way that permanently displaces tenants
- converts the building to condominiums or a cooperative
- changes the use to nonresidential
Coverage. It covers properties of five or more units. Properties of four or fewer, mobile homes, owner-occupied rooms, manager units and employment-tied housing are exempt.
Eligibility. Households at or below 80% of County area median income who are current on rent qualify.
Payment. They receive a full deposit refund, a 60-day rental agency subscription and three months’ rent at the HUD fair market rent. Seniors, disabled tenants, households with minor children and tenants of five or more years get a fourth month.
Notice. Landlords must notify tenants within 30 days of filing an application, and again within 15 days of final approval.

Housing help. The city’s relocation assistance page also notes a community housing fund for lower-income tenants at risk of homelessness. The Housing Division answers landlord and tenant questions.
Transfer tax. The County documentary transfer tax is 55 cents per $500. The County names only the City of San Mateo as adding a city tax, and we found no Menlo Park transfer tax; confirm with escrow.
Short-term rentals. We did not verify Menlo Park’s short-term rental rules; check with the city before underwriting short stays.
Flood zones and older buildings
The Bayfront districts give projects in flood zones or areas exposed to sea-level rise 10 extra feet of height, a sign of how much of that area is low-lying. Check FEMA flood zones and insurance for any Belle Haven or Bayfront building. Older wood-frame apartments with parking under the units warrant a seismic retrofit review, and buildings of three or more units with elevated balconies need SB 721 inspections.
