What multifamily in Elk Grove looks like
Elk Grove’s income property includes garden apartments and townhome communities, duplexes in the low-density districts that allow two-family homes, single-family rentals with ADUs, and a handful of mobile home parks. The city also has a dedicated multifamily overlay that lets apartments locate on commercial land. For two to four units, read financing 2-4 unit properties; for five or more, see apartment building loans.
Where the zoning allows it
Elk Grove is a city with its own zoning, and the residential districts in Chapter 23.24 are named by maximum units per acre. The low-density RD-4 through RD-8 districts allow two-family homes as well as single-family.
| District | Two units | Multifamily | Density |
|---|---|---|---|
| RD-4 to RD-8 | Two-family homes allowed alongside single-family | No | Up to 4–8 per acre; RD-6 to RD-8 allow clusters |
| RD-10, RD-12 | Yes | Lower-density multifamily | Up to 10 or 12 per acre |
| RD-15 | Yes | Multifamily; a transitional district | Up to 15 per acre |
| RD-18, RD-20 | Attached homes | Medium- and high-density multifamily | Up to 18 or 20 per acre |
| RD-25, RD-30, RD-40 | — | Apartments and condominiums | Up to 30 and 40 per acre (the code text lists 30 for RD-25 as well; confirm) |
| MF Multifamily Overlay | — | Apartments on land with a base nonresidential zone | 15.1 minimum to 40 maximum per acre |
| VCMU, RMU Mixed-Use | — | Housing above shops or with supporting retail | Set by district standards |
| RM-1 and MHP combining | — | Mobile home subdivisions and parks | MHP: 5-acre minimum park, 2,940 sq ft sites |
The MF overlay. Shown on the map as "(MF)" after a base zone, the overlay allows multifamily alongside the nonresidential uses of the underlying zone. Projects need a district development plan and design review, and ADUs are allowed under Chapter 23.90. The overlay dates from Ordinance 26-2006 and was last amended effective February 7, 2020.
Mobile home parks. Every new park needs the MHP combining district and a CUP. The city may allow up to 50% more density than the base zone if at least 15% of spaces are designed for single-wide homes.
ADUs and SB 9. Elk Grove’s ADU rules are in Chapter 23.90; state ADU law sets the floor. SB 9 applies to qualifying single-family lots. See our ADU investment guide and SB 9 lot split guide. The code also has a chapter on streamlined housing approvals (23.17) for qualifying projects.
Rent rules: state law only
The Attorney General’s rent cap page, updated July 16, 2026, places Sacramento County in All Other Counties: 7.7% for increases from August 1, 2025 and 8.6% from August 1, 2026 through July 31, 2027. Elk Grove is not on the AG’s local ordinance chart, which lists only the City of Sacramento in this county. Newer buildings may fall under AB 1482’s 15-year new-construction exemption; check the certificate of occupancy date. See our AB 1482 guide and just cause eviction guide.
Elk Grove rental property rules
Rental housing registration. Article XII of the city’s Housing Code makes it unlawful to rent a residential property of 16 or fewer units without registering it with the city.
- What to file. Owner and manager contacts, addresses, unit and building counts, and an emergency contact with authority to act. Changes, including a sale, must be reported within 30 days.
- Term. Registration runs three years, but owners who finish a certified rental property education program can register indefinitely until ownership changes.
- Fees. Set by Council resolution and billed to the owner of record.
- History. The program dates from Ordinance 24-2009, effective March 12, 2010.
The same Housing Code chapter includes a rent escrow program and rental housing enforcement fees. Larger complexes of more than 16 units fall outside the registration article; confirm how the city treats them.
Short-term rentals. Under Chapter 4.38, adopted effective August 21, 2020:
- License. Each address needs its own license, renewable every three years, and the operator must see that the city’s transient occupancy tax is paid.
- Stay length. At least two nights and no more than 30 days.
- No room rentals. Renting individual rooms to separate guests, and open-invitation parties, are prohibited.
- Penalties. Civil penalties run up to $250 a day; a second violation in a year brings a 180-day suspension and a third, revocation.
Transfer tax. Elk Grove has a $0.275 per $500 transfer tax chapter, while the County Clerk-Recorder names only the City of Sacramento as adding a city tax to the County’s $0.55 per $500, which suggests Elk Grove’s share sits inside the County rate. Confirm with escrow.
Flood zones, newer buildings and inspections
Elk Grove maps an F Flood Combining district for land subject to river and creek flooding, which can add elevation and insurance requirements. Newer complexes still need SB 721 balcony inspections when they have three or more units and elevated decks or stairs. Older wood-frame buildings warrant a seismic retrofit review. In newer neighborhoods, check community facilities district taxes on the bill.
