What multifamily in Clearlake Oaks looks like

Clearlake Oaks began as a 1920s subdivision called Stubbs, and much of its housing still sits on small lots platted then. Its income property is mostly duplexes, small multi-unit buildings, cottage courts, older motels used for longer stays, and mobile homes. The canal-front Clearlake Keys neighborhood adds its own mix. The Shoreline Communities Area Plan counted about 2,402 residents in 2000 and estimated 2,814 in 2008, with an average household of about two people. It identifies roughly 120 acres in Clearlake Oaks for high-density residential development, three times the Lucerne figure. For financing, see financing 2-4 unit properties and apartment building loans.

Where the zoning allows it

Clearlake Oaks is unincorporated, so the Lake County zoning ordinance applies. Districts allowing two or more units:

District 2+ units Density Min lot (public water+sewer / one public / well+septic) Height
R2 Two-Family Up to five duplexes per project by right; more by major use permit 4,000 sq ft per duplex unit 8,000 / 15,000 / 40,000 sq ft 35 ft
R3 Multi-Family Duplex through apartments; 20+ units by right if objective standards are met Lot size, coverage and open space control 10,000 / 20,000 / 40,000 sq ft 45 ft
C2 Community Commercial Units on second floor and up; housing where services exist 2,292 sq ft per unit 8,000 / 15,000 / 40,000 sq ft 40 ft multifamily

The area plan suggests housing above shops at the Plaza, which would fall under C2-type rules. R3 projects need 100 square feet of private open space per unit, plus 300 square feet of recreation area per unit when there are more than seven units. Condominiums and townhouses in R3 need a major use permit.

ADUs. County rules allow one granny unit or second unit per lot in R2 under Article 27. Granny units are capped at 720 square feet on lots under 40,000 square feet. State ADU law may allow more, so confirm the current standard with the county. See our ADU investment guide.

SB 9. SB 9 can apply to unincorporated land in census-defined urban areas. Ask the county whether a particular Clearlake Oaks lot qualifies, and note that fire hazard zones, septic and flood limits may control. See our SB 9 lot split guide.

Rent rules: state law only

The Attorney General’s rent cap page lists no local rent control in Lake County. The "All Other Counties" row sets 7.7% for increases from August 1, 2025, and 8.6% from August 1, 2026 through July 31, 2027. State just cause rules apply to covered tenancies. See our AB 1482 guide and just cause eviction guide. Unlike the City of Clearlake down the road, the county has no rental registration program in the code we reviewed.

Clearlake Oaks rental property rules

  • Mobile home parks. Under county Article 43, new parks need a major use permit, at least 5 acres and no more than 10 spaces per acre. Closing or converting a park requires a relocation plan and an impact report.
  • Motels used as housing. The plan asks that CR lodging rules on Short Street be strictly enforced. If a motel is rented month to month, confirm its legal use before buying. Stays of 30 days or less owe the county’s 9% transient occupancy tax.
  • Short-term rentals. In July 2026, the county announced a committee to help draft rules for short-term rentals in unincorporated areas. Treat vacation-rental income as uncertain until the ordinance is adopted.
  • Condo conversions. These need a major use permit under Article 44.

Sewer, the Keys and site constraints

  • Water and sewer. The Clearlake Oaks County Water District provides both. Lake LAFCo’s sanitation service review reports that wet-weather inflow and infiltration push plant flows well above the dry-weather average. Ask the district about capacity and connection fees for added units. The district’s 2026 water rehabilitation project addresses storage tanks, pipelines and fire-flow storage.
  • Septic lots. Off the sewer system, every district requires 40,000 square feet, which usually rules out added units on older small lots.
  • The Keys. The channels are private and owners maintain them, including dredging. Budget HOA or channel costs on any Keys rental.
  • Fire. Northshore Fire Protection District charges a $60 Clearlake Oaks special tax, according to Lake LAFCo’s 2025 fire review.
  • Hillside erosion. The area plan flags erosion and drainage on the paper lots behind town.
  • Older buildings. Consider a seismic retrofit review for older wood-frame buildings. Buildings of three or more units with elevated decks need SB 721 inspections.

Underwriting a Clearlake Oaks multifamily purchase

  1. Confirm the county district, the lot area and whether the parcel is on CLOCWD sewer or a septic system.
  2. Test the unit count: 4,000 square feet per duplex unit in R2, and the R3 lot, coverage and open space rules.
  3. Classify units under AB 1482 and model increases at or below 8.6%.
  4. For motels, cottage courts or short-term units, confirm the legal use and TOT history.
  5. Collect leases and two years of statements, and get estoppel certificates.
  6. Rebuild expenses with reassessed taxes, district charges and Keys channel costs in our rental property analysis.
