Commercial Real Estate in Lucerne: The Promenade, The Strand and Lake County Zoning
By Matthew Martinez, Founder, CEO & Managing Broker, Diamond Real Estate Group. California DRE #01869679.
Lucerne is an unincorporated north shore town where Highway 20 runs right along Clear Lake. Its commercial property sits on the lakefront strip the county calls the Promenade, on 13th Avenue (The Strand), and in scattered resort and service sites. Lake County controls zoning, so each parcel’s county district, area plan designation and utility connections must be confirmed with Community Development before you count on a use.
Who controls the parcel
Lucerne has no city government. The agencies are:
- Land use: Lake County, under the county zoning ordinance and the Shoreline Communities Area Plan. The 2008 General Plan treats Lucerne’s community area as a Community Growth Boundary, where more development may fit subject to environmental and safety limits.
- Sewer: The Lake County Sanitation District (LACOSAN) serves Lucerne through its Northwest Regional plant. Lake LAFCo’s 2010 service review counted 1,491 Lucerne connections in August 2010. It also noted a 2003 cease and desist order on the Northwest Regional system over inundation and discharges to Clear Lake.
- Water: California Water Service serves Lucerne as part of its Redwood Valley district. The water is Clear Lake surface water bought from the Yolo County Flood Control and Water Conservation District and treated at Cal Water’s plant. As an investor-owned utility, its rates are set by the CPUC.
- Fire: Lake LAFCo’s 2025 fire review places Lucerne in the Northshore Fire Protection District and lists a $60 Lucerne Park and Recreation special tax among the district’s components.
Lucerne zoning for commercial, resort and mixed use
| District | Intended uses | Notes |
|---|---|---|
| C2 Community Commercial | Retail, restaurants, offices; upper-floor housing | By right: enclosed, up to 5,000 sq ft per use, 6 a.m. to midnight, no drive-thru. Up to 8,000 sq ft, drive-thrus, hotels over 15 units and quiet bars by minor permit. Bars with amplified music by major permit |
| C1 Local Commercial | Small neighborhood shops | By right up to 2,000 sq ft per use, 6 a.m. to 10 p.m. |
| CR Resort Commercial | Lakefront lodging, restaurants, guest docks | Motels up to 15 units by right. Restaurants to 3,000 sq ft by right, to 6,000 by minor permit. 50% coverage, 35 ft |
| PDC Planned Development Commercial | Master-planned commercial | The area plan applies it to The Strand and the Utopia Mine site |
Minimum lots in these districts run 8,000 square feet on public water and sewer. Because Lucerne has both Cal Water and LACOSAN service, many parcels can use the smallest lot standard. Confirm the connection, though, since a parcel on septic needs 15,000 square feet.
The Promenade, The Strand and the Utopia Mine site
The Shoreline Communities Area Plan sets out a different future for each part of Lucerne’s commercial area:
- The Promenade. This is the Highway 20 lakefront strip. The plan wants it to become a working lakefront downtown with several public lake access points and gathering spaces. It encourages multifamily housing on the north side of Highway 20, where units would have lake views. The plan’s Section 7 holds design guidelines for this area.
- The Strand (13th Avenue). Commercial uses are meant to concentrate toward 13th Avenue. The plan says The Strand needs steps to improve its economic viability and a more varied mix of businesses, and it applies Planned Development Commercial there.
- Utopia Mine site. The plan also applies Planned Development Commercial to this former mine site. A PDC approach means a site development plan, not a simple building permit.
The plan we reviewed is labeled a 2009 Planning Commission draft. Ask the county whether an adopted version changed these designations.
Lodging, cannabis and lakefront rules
- Motels and resorts. CR allows up to 15 rooms by right, 16 to 25 with a minor use permit and more than 25 with a major use permit. In C2, hotels over 15 units also need a minor permit. Caretaker or employee quarters with a 16-plus-unit hotel need a minor permit in CR.
- Boat rentals. Boat, houseboat and jet-ski rentals in CR need a major use permit. Piers and docks are allowed only as accessories for hotel or restaurant guests.
- Cannabis retail. County C1 and C2 list retail cannabis sales as a minor use permit use after the 2026 amendments.
- Waterways. Lucerne lies in the Morrison Creek watershed. The county Waterway combining district generally keeps new work 30 feet from perennial streams and 20 feet from intermittent ones.
- Paper lots. The Clearlake Beach Company created hundreds of small, unserved lots here in 1923–24. The plan warns that building out the hillside lots can cause erosion and drainage problems.
Transfer tax, business tax and property tax
Only the county’s documentary transfer tax applies: $1.10 per $1,000 under the Assessor-Recorder fee schedule. Lodging owes the county’s 9% transient occupancy tax. A sale generally triggers Proposition 13 reassessment, and bills carry district charges such as the Northshore fire special tax. We did not verify a county business license tax.
Due diligence that matters in Lucerne
Start with our commercial due diligence checklist, then add:
- Confirm the county district and whether the parcel is on the Promenade, The Strand or a PDC site.
- Get LACOSAN sewer capacity confirmation and a Cal Water service letter.
- Measure the tenant’s floor area and hours against the C1 or C2 by-right limits.
- For motels, check the unit count against the CR and C2 thresholds and the TOT history.
- On lakefront parcels, check dock and shoreline permits and Rumsey gauge levels.
- On hillside parcels, review drainage and erosion control.
